REGULATION ON AMENDING THE REGULATION
The phrase "two" in the 6th paragraph of Article 8 of the Regulation on the Procedure for Initiating Proceedings for Monetary Claims Arising from Subscription Agreements, published in the Official Gazette dated 29/5/2019 and numbered 30788, has been changed to "five".
This change affects the process of initiating enforcement proceedings for the collection of monetary claims by service providers under subscription agreements. With the new regulation, a request for proceedings regarding monetary claims arising from a subscription agreement must be made within five years from the date of the warning notice sent to the debtor's last known address.
Otherwise, the claim will be subject to the statute of limitations. This period was previously set at two years. The purpose of this change in the regulation is to enable service providers under subscription agreements to collect their claims more easily and to provide debtors with more payment opportunities.
It was announced that the 2nd and 3rd sentences of the 4th paragraph of Article 12 of the regulation have been repealed, and the phrase "two" in the 5th paragraph of the same article has been changed to "five".
Furthermore, the phrase "signature circular" in the 1st paragraph of Article 13 of the same regulation has been changed to "registration certificate".
This regulation enters into force on the date of its publication in the Official Gazette, and its provisions are executed by the Minister of Justice.
