Constitutional Court rejects Fenerbahçe's application

The Constitutional Court has issued a significant ruling regarding the individual application filed following the armed attack on the Fenerbahçe football team in Trabzon on April 4, 2015. The application, which alleged that the right to life had been violated, argued that the investigation process following the attack was insufficient and that decisions of non-prosecution were issued for some suspects.

While evaluating the application, the High Court focused on the procedural aspect of the right to life under Article 17 of the Constitution. The court declared the application admissible and examined the case on its merits. As a result of its review, it ruled that the investigation conducted into the incident did not constitute a violation in the context of the constitutional right to life.

The Fenerbahçe football team was subjected to an armed attack in Trabzon on the night of April 4, 2015, while returning from an away match against Çaykur Rizespor. The investigation into the attack concluded with a decision of non-prosecution approximately five and a half years later. The Fenerbahçe community and some team members had taken the matter to the Constitutional Court, alleging that the investigation was not conducted effectively.
