After a social media user pointed to lawyer Prof. Dr. Ersan Şen—who represented two contractor brothers who fled abroad after 51 people lost their lives in an earthquake in Gaziantep—this possibility was widely debated.

Şen stated the following: Eylem Tok is not guilty for taking her child away. She would be guilty if she destroyed evidence. Eylem Tok will be tried for causing death by negligence by providing the vehicle.
