2-year prison sentence requested for former Ataşehir Mayor Battal İlgezdi

An indictment has been prepared against Battal İlgezdi, the former mayor of Ataşehir Municipality in Istanbul. The indictment requests up to 2 years in prison for İlgezdi and 8 other suspects for the crime of misconduct in public office, alleging that they failed to comply with decisions to demolish certain structures built in violation of the Zoning Law.

An indictment has been prepared against former Ataşehir Mayor Battal İlgezdi for the crime of misconduct in public office, alleging that during his tenure, he failed to implement demolition orders for 6 structures built in violation of their permits.

The indictment, prepared by the Anadolu Chief Public Prosecutor's Office Special Crimes Investigation Bureau, includes the preliminary investigation report prepared by the Ministry of Interior's civil inspectors regarding structures in Ataşehir that violate zoning regulations.

According to the report, there were certain projects in the district built in violation of the Zoning Law, and it was decided that action should be taken for some of them under Article 32 of the law, which covers regulations regarding unlicensed or non-compliant structures; however, it was stated that municipal officials did not comply with this.

DECISION NOT FOLLOWED

The indictment explains that upon this, the Ministry of Interior granted permission for an investigation into İlgezdi and 8 others on the grounds that they abused their duties, and that an appeal made to the Council of State was rejected. It was noted that İlgezdi and the 8 suspects did not comply with the decisions taken by the Municipal Committee between 2020 and 2021 regarding the demolition of structures that violated permits for 6 properties in the district.

FROM THE INDICTMENT

The indictment requests that Battal İlgezdi, Mahmut Murt, Mehmet Ali Düzova, Sinem Taş, Aysun Gökçen, Cenan Arslan, İlhami Yılmaz, Kalender Özdemir, and Mahmut Benli, who stated that they did not accept the accusations, be sentenced to between 6 months and 2 years in prison for the crime of misconduct in public office.

The trial of the suspects will begin in the coming days within the scope of the indictment accepted by the Anadolu Criminal Court of First Instance.
