Prosecutor recounts the incident: 'I was punched in the ear, my mother-in-law and my baby in her arms fell to the ground'

Public Prosecutor Mücahid Şamil Koca gave a statement as a "complainant" to the prosecutor after arriving at the Aybastı Central Gendarmerie Command following the incident that took place at a restaurant in the Aybastı district of Ordu on August 4.

Stating that he has been serving at the Ünye Chief Public Prosecutor's Office for 2.5 months, Koca said that he went to a business in the Perşembe Plateau in the Aybastı district with his wife, father-in-law, mother-in-law, 9.5-month-old daughter, and his wife's 9-year-old nephew to spend his weekend leave upon recommendation.

Koca recounted what happened after entering the business as follows:

"Before even sitting at a table or placing an order, and considering the possibility of leaving, I asked a business employee, whose name I do not remember now, 'If we place an order, how many minutes will it take to be ready?' He told me, 'It will come out in about 20 minutes.' We wanted to go upstairs, but the attendant said there was cleaning going on upstairs and that he could have the round table on the lower floor prepared for us. At that moment, Yücel G., who was standing at the cash register and whom I think heard us and whose name I learned later within the scope of the investigation, said, 'It will take about 30 minutes for the food to be prepared.' Because of the aggressive attitudes of the employees, both for not letting us go upstairs and for stating different times, we wanted to leave the business, and we left with my family without saying anything to anyone. We went in front of another business in the center of the plateau, about 30-40 meters away. Because that place and other shops were empty, and also because the gendarmerie had recommended it, we decided to eat at the same place again. Except for my wife, the other family members waited in front of the business. My wife and I entered the business and wanted to sit at the round table they had suggested about 2 minutes earlier. This time, an employee working there asked us if we had placed an order. I said we were about to place it now."

Stating that upon this, the employee told him they had to wait for 1 hour, Koca noted the following:

"Upon this, I asked, 'Why 1 hour? You said 20-30 minutes just a moment ago, what happened in 3 minutes?' The waiter told me they had received a new order. Since I thought the attitude of the business employees was inconsistent and mocking people, I said, 'Doesn't this place have a manager? I want to speak to them,' and I went over to Yücel G., who was standing at the cash register. This time, since I had received a recommendation from law enforcement, I said to him, 'I am the Ünye Public Prosecutor, law enforcement recommended this place to us. Isn't what you are doing shameful?' He directly displayed an aggressive attitude and said, 'Why are you stating your identity now? I am also a 28-year-old...' but I don't remember the rest right now. When other business employees who heard our voices rising came over, I saw the employees who had given me the times earlier and, pointing them out to Yücel G., I said, 'This one said 20 minutes, this one said 1 hour, and you said 30 minutes. Are you mocking us?' He said to me, 'Why do you keep entering and leaving the shop?' I said, 'I am a customer, of course I will enter and leave.'"

"I SAW THAT MY 9.5-MONTH-OLD DAUGHTER HAD BEEN INJURED ON HER HEAD"

In his statement, Koca also conveyed the following regarding the commotion that occurred:

"Upon this, an employee standing there, whom I do not remember now, made hand gestures with an aggressive attitude and addressed me by saying, 'What are you saying?' My wife and I, feeling uncomfortable with the attitude of the business employees, went outside the business. At this moment, I saw Erkan G., whom I thought was a business employee due to his apron and whose name I learned later, and while I was complaining to him again, saying, 'What kind of disgrace is this? Are you mocking people? You all say different times,' he walked towards me. The employees there separated him. At this moment, Abdülsamet A., whose name I also learned later, ran towards me very quickly from inside the business, but the individuals and employees there held him back as well. While I was focused on him, I was punched in my right ear from behind, but I did not notice who hit me. A commotion broke out there at that moment. In this commotion, my mother-in-law, Selime Kırım, and my 9.5-month-old daughter in her arms fell to the ground. Afterwards, Ercan G., whose name I also learned later, ran from inside the business and walked towards me, but they held him back too. Later, we left the scene and I informed the gendarmerie. After the events calmed down, I saw that my 9.5-month-old daughter had been injured on her head due to the commotion that occurred during the incident, and I learned that my mother-in-law also had pain in her hip."

Koca stated that he filed a complaint against business employees Erkan G., Ercan G., and Abdülsamet A. for walking towards him, and against Yücel G. for inciting the other individuals.

Erkan G., who was detained yesterday within the scope of the investigation carried out by the Fatsa Chief Public Prosecutor's Office, was arrested by the judgeship he was brought before. A judicial control decision and a house arrest order were issued for Abdüssamed A. Ercan G. was released after his statement at the prosecutor's office.
