She had insulted Musa Orhan: Second penalty for Farah Zeynep Abdullah

In the case filed against actress Farah Zeynep Abdullah on charges of insulting former expert sergeant Musa Orhan—who is accused of sexually assaulting İpek Er, who died by suicide in Batman—on social media, a judicial fine of 1,740 TL, equivalent to 87 days, was imposed.

According to the report by Asuman Aranca from T24, the court decided to defer the announcement of the verdict. In her defense at the court, Abdullah's lawyer stated, "What young woman would remain silent when reading the news of a suicide resulting from a rape?" and argued that Musa Orhan has "turned the lawsuits he filed against the reactions shown to him into a source of income."

A lawsuit was filed against actress Farah Zeynep Abdullah, who supported her colleague Ezgi Mola—who had been sentenced to a 65-day judicial fine for insulting Musa Orhan, the expert sergeant who wrote in a letter left behind by İpek Er that he had sexually assaulted her—following a complaint by Orhan on charges of "insulting.".

'MY INTENTION WAS NOT TO INSULT'

In the case heard at the Banaz Criminal Court of First Instance, Abdullah stated in her testimony given via rogatory commission in November, "I read about the incident. It was horrific. I made the post mentioned in the indictment. My intention was definitely not to insult Musa Orhan. It was a reaction to the news reports."

ABDULLAH'S LAWYER OBJECTED TO THE PROSECUTOR'S OPINION

In the second hearing of the case held on February 2, the prosecutor, who announced his opinion on the merits, requested that Abdullah be punished for the crime of insult due to her social media post.

Abdullah's lawyer objected to the prosecutor's opinion, stating, "The crime of insult requires high intent; it must be clear whether the statement made is directed at an action or a person."

'HE SEES IT AS A SOURCE OF INCOME'

Stating that İpek Er was 18 years old when she lost her life, that there was a nationwide reaction to her death, and that Orhan turned these reactions into a "source of income" by filing lawsuits, the lawyer said, "The complainant caused the death of a 17-18-year-old young girl by violating her; prominent figures in the country, especially celebrities, reacted to this incident. Since the complainant sees the aforementioned reactions as a source of income, he only directs lawsuits at famous names.

My client's post is against the complainant's wrongful act; as stated in established case law, it is not a requirement that this wrongful act be directed at the person themselves; my client is a young woman. What young woman would remain silent when reading the news of a suicide resulting from a rape? It is important for people known by society to react to events of the type carried out by the complainant; thanks to these reactions, individuals who might act like the complainant will think twice about their actions," he stated.

REQUESTED ACQUITTAL

Abdullah's lawyer requested an acquittal, noting that the court had issued an acquittal in a case Orhan filed against another actress, Hazal Kaya.

The court ruled that Farah Zeynep Abdullah had committed the "crime of insult" and sentenced her to a judicial fine of 1,740 TL, equivalent to 87 days.

The court decided to defer the announcement of the verdict.
