İYİ Party Chair Akşener: The conflict between the Constitutional Court and the Court of Cassation will have 'grave consequences'

In a written statement, Akşener expressed that the developments in Turkey show that the country is facing a serious crisis that targets the concept of a constitutional state.

Recalling the ruling by the 3rd Criminal Chamber of the Court of Cassation that it would not comply with the Constitutional Court's decision regarding a violation of rights, Akşener assessed, "It is clear that we are facing a result where the decisions of the Constitutional Court cannot be implemented and the Constitutional Court is rendered unable to perform its duties. Therefore, the current situation is essentially a 'constitutional/state' crisis."

Expressing concern over the security of the constitutional legal order in Turkey, Akşener stated, "I would like to remind everyone with a sense of responsibility once again that such divisions and conflicts directed at the survival of our state will have grave consequences."

Touching upon President Recep Tayyip Erdoğan's statements on the matter, Akşener noted the following:

"In his assessment today, Mr. Erdoğan stated that his role is that of an 'arbitrator' rather than a 'party,' and felt the need to demonstrate that he would 'rapidly take steps to prevent the disagreement between our institutions from turning into a constitutional and systemic crisis,' and that he would 'find a solution to the issue by meeting with the representatives of our high judicial institutions.'

I believe this change in attitude is important for contributing to the resolution of the crisis we are experiencing, and I hope it will continue.

Our legitimate expectation to end the crisis is for the President to emphasize the finality and binding nature of the Constitutional Court's decisions within the framework of the duties and responsibilities granted by the Constitution, and to support the Constitutional Court within the order established by the Constitution and laws against such a decision that would effectively suspend the rule of law.

It would also be important for the Speaker of the Grand National Assembly of Turkey (TBMM), in the face of the decision by the 3rd Criminal Chamber of the Court of Cassation which targets the TBMM, to emphasize the binding nature of the Constitutional Court's decisions and to adopt a stance expressing that he will act according to the final decision within the framework of the duties written in the Constitution, in order to uphold the functioning and law of the TBMM."
