The People's Alliance's Constitutional Court plan: Will that detail be added to Article 14 of the Constitution?

In the case of Workers' Party of Turkey (TİP) Hatay MP Can Atalay, for whom the Constitutional Court (AYM) has issued a second ruling of rights violation, the file has been sent once again to the Court of Cassation by the 13th High Criminal Court.

Sözcü columnist İsmail Saymaz wrote about the People's Alliance's "Constitutional Court plan" in his column today.

Stating that the 3rd Criminal Chamber of the Court of Cassation will not implement the Constitutional Court's decision, Saymaz said, "The People's Alliance will make a move to strip Atalay of his parliamentary seat. Atalay's release will be prevented."

ARTICLE 14 PLAN

"If the People's Alliance can persuade the opposition, it plans to amend Article 14 of the Constitution," wrote Saymaz, adding:

"Which crimes in the Turkish Penal Code will be considered terror crimes will be written into Article 14. The goal is to strip the Constitutional Court of its authority to order retrials and releases in individual applications. The Constitutional Court will only be able to rule for compensation."

In his column, Saymaz also shared the information that "However, for these changes, the People's Alliance needs to find 400 votes in the Grand National Assembly of Turkey (TBMM)."

WHAT IS ARTICLE 14 OF THE CONSTITUTION?

Article 14 of the Constitution states the following:

"None of the rights and freedoms embodied in the Constitution shall be exercised in the form of activities aiming to violate the indivisible integrity of the State with its territory and nation, and to eliminate the democratic and secular Republic based on human rights. No provision of the Constitution shall be interpreted in a manner that enables the State or individuals to engage in activities aiming to destroy the fundamental rights and freedoms recognized by the Constitution or to restrict them more extensively than as specified in the Constitution. The sanctions to be applied against those who engage in activities contrary to these provisions shall be regulated by law."
