Will the PKK Law be rushed through by August 15th?!

The 12-article PKK law, which is considered the "first step" by those who signed and supported the proposal—following the terrorist leader in İmralı, Kandil, and the DEM Party members—was accepted by the TBMM Justice Commission the day before yesterday. It will be discussed in the General Assembly starting today.

All legal experts state that this is contrary to the Constitution and the laws, and is full of contradictions. In its current form, it is also being wondered whether it was prepared by the terrorist leader in İmralı.

We said it is "considered the first step"; because the terrorist organization front explains that with this law, the "Kurdish identity" is recognized in a legal sense for the first time, that the terrorist leader is accepted as the "leader and chief negotiator" of the Kurds, and that more will follow starting in October. It is clear what will follow: autonomy for local administrations, education in the mother tongue, and equal citizenship.

It is also explained that with the process called the "Turkey model," the foundations of a "democratic republic" are being laid and a brand new Turkish-Kurdish brotherhood will be established.

As for the law that provides PKK terrorists the opportunity to engage in politics on "flat ground"; let us provide these technical details to understand its "author-architect" and what we are facing:

- The name of the law, which the government calls a "framework" and the PKK wing calls the "root," is: "Draft Law on Strengthening National Solidarity and Social Integration."

- Two boards will be established to confirm and determine that the terrorists have laid down their arms. One is the "Evaluation and Coordination Board" chaired by the Vice President, and the other is the 17-member Monitoring Board to be established by law within the TBMM, but which will not be subject to the Parliament's Internal Regulations.

- Those who fulfill the duties assigned within the scope of this law, especially the members of the "PKK Commission" illegally established in the TBMM, will be granted a shield of immunity.

This draft law also has a "general justification" section, which we could say is "more important than the law itself." Because it contains expressions such as:

- "A vision that will further strengthen the democratic rule of law nature of the state"...

- "Common citizenship consciousness"...

- "Elimination of armed structures and strengthening the space for democratic politics"...

- "Considering the dynamic structure of the process, making additional changes to the relevant legislation or enacting new legal regulations in order to ensure that the process progresses in accordance with its goal, in line with the needs that may arise during implementation, experiences to be gained, and changing conditions and requirements"...

- "Re-establishing peace and brotherhood not only in our country but in the entire geography that our country is also a part of"...

Have We Lost Our Memory?

Someone must think that we have completely lost our memory, as they are putting these in front of us as if they were new.

In that case, it falls to us to remind you of what was recorded under the name "İmralı Notes" during the first resolution process.

Let us start with what the terrorist leader said to the delegation that went to İmralı on January 3, 2013:

- "The existence of the Kurdish people has not yet been accepted by the state. Their existence must be accepted. We will evaluate this when the CHP joins the commission. Not only their language, but their brain, their body, that is, their existence must be accepted. How will you make a constitution without the Kurdish reality being accepted by the parliament? In this regard, you can take the 1921 Constitution and the twenty-article Kurdish Reform Proposal as a basis. There is the acceptance of the existence of Kurds there. We want to revive the Kurdish Reform Proposal dated February 9, 1922."

- "We will go to true peace with Turkish-Kurdish peace. They have dynamited and poisoned the relations of these two societies... I am not a nation-stater. This is the root cause of the massacres. Nation-state means slavery, not freedom."

- "We want to make Kurds a democratic unit. There will be no peace without this in the Turkish Constitution and laws... I am not even discussing language education. There will be legislative rights, economic autonomy. The reservations in the European Charter of Local Self-Government will be lifted."

In March 2013, stating that the work should start primarily with the parliament taking a decision and establishing commissions, and that the first of these should be a commission consisting of deputies, he said, "A special commission is established by law. This commission oversees the entire non-conflict process, including withdrawal."

Noting that what they did subsequently was "illegal" and that the Parliament should end this illegality by passing a law, while drawing attention to the investigation opened against the MİT officials of the period who carried out the process, he requested the following regarding himself:

"The KCK has written 'our leader,' the people say 'president,' everyone assigns a mission. I am the person who will end this rebellion. Therefore, how the parliament will define me is important. Just think, a prisoner facing aggravated life imprisonment is submitting a proposal that will come to the parliament's agenda! In what capacity am I doing this, is this legal? No, it is a crime. This illegality will have to be resolved in some way."

In April 2013, he threw down the gauntlet: "If I said we ended the historical conflict process, I am not saying peace has been achieved; I am talking about universal commitment to legal politics and struggle. I have not given up on anything. I am just saying that none of these will happen without a democratic Turkey... First, there must be a democratic Turkey."

The Name of the Terrorist Leader's Law

In June 2013, while explaining that he had prepared a "negotiation framework law" in response to the then-Prime Minister's call to "come to democratic politics, to the struggle of ideas," he commanded, "There may not be a general amnesty like that. The Parliament has to find a way. It has to find a way without distinguishing between executive and militant. Sick prisoners must be released immediately."

He named that "negotiation framework law" the "Draft Law on the Termination of Terrorism and Strengthening Social Integration."

What is the difference from the name of today's proposal; "national solidarity" was put in place of "termination of terrorism."

We had said, "Since the law is being enacted from A to Z for the separatist terrorist organization; wouldn't it have been better if it were called 'Strengthening Solidarity with the PKK and Integration with the PKK'?" Were we wrong?!

So, what was in that draft law that the terrorist leader prepared and claimed would "open the door to a Middle East revolution"? For example, articles like these:

- "The state determines the steps it can take in the fields of political, legal, diplomatic, socio-economic, psychological, cultural, human rights, security, and disarmament for the termination of terrorism and the strengthening of social integration within the scope of the resolution process... It takes the necessary measures for the return home, participation in social life, and adaptation of organization members who lay down their arms. It carries out the necessary legislative work on these issues... It monitors the implementation results regarding the measures taken and ensures coordination between the relevant persons, institutions, and organizations."

- "The Undersecretariat of Public Order and Security carries out all matters related to the resolution process."

- "Persons and officials who fulfill the duties assigned to relevant institutions within the scope of the law shall not have legal and criminal liability, and cannot be punished for this reason."

Then?

He asked the delegation that went to İmralı at the beginning of June 2014 when the Parliament was going on recess, saying, "We do not have the patience to wait for this for months."

Upon Pervin Buldan's reply, "Around the end of this month," he gave the following instruction:

"So there are 20-25 days left here. Now, as soon as you leave here, you will go to Ankara and meet with Mr. Beşir (Atalay), Mr. Efkan (Ala), and your other interlocutors. You will say, 'There is no playing games with Apo, we are not in a position to wait for this for months.' We can accept it even in this form, but it must be passed before the Parliament closes, otherwise I don't know... It must be passed before the presidential election... All problems will be solved with this law, interlocutorship and everything will be solved... The fate of the Middle East is changing. With these regulations, we will lay the foundation not only of the new Turkey but also of the new Middle East."

When that draft law was submitted to Parliament, MHP's Oktay Vural identified it as, "Apo wanted it, they are doing it."

In his meeting with the İmralı delegation on June 26, the terrorist leader reacted to these words of Vural, saying, "What does it have to do with me? The state is doing it for itself."

Sırrı Süreyya Önder listed his praises: "You have achieved here what no one has achieved until today. You made the state pass a law through negotiation. I think this law is historical. It has also come to the Parliament. There is no equal to it in these lands. Neither Muslims nor Alevis nor socialist structures have been able to achieve this. You have achieved it... After this law is passed, even if they curse us for pages, I think we should not care. One should look at who has achieved what from the state with what struggle until today."

The terrorist leader replied, "It is a very simple law for me. It may be important, but in my opinion, a state should not lower itself to this state, it should not put the enactment of a law into such a different picture."

When Pervin Buldan noted that it should be "supported by a democratization package," the terrorist leader said the following:

"If the negotiation delegation, the Monitoring Board, and the State delegation start their duties as three main boards, we will discuss it. It won't happen without these... We will give authority to the Monitoring Board to be established on this matter... The Monitoring Board can work like an ombudsman."

In the end, the TBMM accepted that law on July 10, 2014.

It is clear that we are experiencing almost the same process 12 years later.

As is known, the TBMM was supposed to go on recess on July 1; but the working period was extended for this new law. It will start to be discussed in the General Assembly today.

What is the significance of today? It is the anniversary of the Treaty of Sèvres, which the separatist terrorist organization targets.

Of course, it is not possible for 12 articles to be accepted in one day; it will probably take 4-5 days.
