Sermiyan Midyat wins lawsuit against production company
Actor Sermiyan Midyat has won the lawsuit he filed after claiming he was victimized when the film 'Cellabi', in which he was set to star, was never produced. The court ordered Blackwell Productions to pay Midyat 118,717 Turkish Lira and 50 kuruş in compensation, along with a 200,000 Turkish Lira penalty clause.
Director, actor, and screenwriter Sermiyan Midyat had signed an agreement with a production company named Blackwell Productions to star in a film titled "Cellabi," which was planned to be shot in Mersin. However, when the project did not materialize, Midyat filed a lawsuit at the Istanbul Civil Court of First Instance.
In the petition, it was stated that the production company had collected money from local people in Mersin with the promise of giving them roles in the film, and that these individuals had sent messages to Midyat after the film was not produced. The actor stated that he had sent a formal notice through a notary after filming did not begin within the time specified in the contract, but received a negative response.
5-YEAR LAWSUIT CONCLUDED
The lawsuit, which had been ongoing for approximately 5 years, was concluded at the Istanbul Civil Court of First Instance. Midyat's lawyer, Baver Tulpar Karakuş, and Blackwell Productions' lawyer, Yusuf Ergün, attended the hearing. While Midyat's lawyer requested that the case be accepted, the defendant's lawyer requested that the case be dismissed.
COURT FINDS IN FAVOR OF MIDYAT
The court found in favor of Sermiyan Midyat. In the ruling, it was ordered that Blackwell Productions Yapım A.Ş. pay Midyat 118,717 Turkish Lira and 50 kuruş in compensation and a 200,000 Turkish Lira penalty clause, along with 5 years of interest.
