20,000 Lira Injunction on a Billion-Lira Peninsula: Case Reopened After 44 Years!

The 430-dekar peninsula located on block 119, parcel 21 in Türkbükü, Bodrum, Muğla, was registered in the name of the Treasury of Finance in 1978. An objection filed that same year by the heirs of İbrahim İdris, son of Hasan, was rejected by the Bodrum Civil Court of First Instance, and the decision was upheld by the Court of Cassation in 1985.

After 44 years, a new application was filed by relatives of the original plaintiffs. In the lawsuit filed under the power of attorney of Metin Karakaya, Nazmi Yiğit, Ömer Baltacı, and Attorney Nimet Çelen, a request was made against the Treasury for the "cancellation of the title deed, an injunction, and registration."

ONLY 20,000 LIRA SECURITY DEPOSIT

An injunction was requested in the petition submitted to the court. The court accepted this request and placed an injunction on the 430-dekar land with a security deposit of only 20,000 TL.

The expert report recorded the value of the land at 4 billion 308 million TL. Compared to this figure, the 20,000 TL security deposit has sparked significant public backlash.

Mehmet Kaçmaz, the lawyer for the Ministry of Environment, Urbanization and Climate Change and the Ministry of Treasury and Finance, stated that the case should be dismissed due to the statute of limitations. In his application, Kaçmaz emphasized that a lawsuit could not be filed in 2022 based on a cadastral decision finalized in 1978, as the legal time limit had long since expired.

However, despite all these objections, the case was accepted, and the land was appraised through an expert examination.

MINISTRY LAWYERS WERE NOT IN THE FILE

According to journalist Murat Ağırel, the lawyers for the Treasury and the Ministry of Environment and Urbanization did not follow the file during the expert discovery process because they were on leave. The same situation occurred during the litigation process. This development has raised questions in the public eye: "Is Treasury property not being protected sufficiently?"

YACHT HARBOR AND HOTEL PLAN

It has been alleged that plans for the land in question include projects such as a yacht harbor, marina, golf hotel, and shopping area. According to reports on the subject, it has become a matter of curiosity which businesspeople or political associates the land will be linked to in the future.

Journalist Murat Ağırel drew attention to the following statements in his article published in the Cumhuriyet newspaper regarding the issue:

"We live in a country where billions in land are changing hands on paper through legal games, while a large portion of the public cannot even afford to eat cherries. It is our duty to voice this contradiction."

Ağırel emphasized that it will become clear in the coming process whether Treasury property will be protected, but that it is unacceptable for public assets to fall into the hands of a handful of interest groups during a period when the law is being violated so recklessly.
