Police allegedly obtained fake medical report for Sertçelik in ABK case: 'The prosecutor knows...'

Halk TV columnist İsmail Saymaz wrote that five police officers on trial for their involvement with Serdar Sertçelik (M7), known as a secret witness in the Ayhan Bora Kaplan (ABK) case, went to the Ankara Etlik City Hospital, where Sertçelik was receiving treatment, on November 24 and obtained a stamped report from a doctor stating, "There is a medical objection to taking the individual into custody."

THEY REQUESTED A FAKE REPORT

A lawsuit was filed at the Ankara 17th Criminal Court of First Instance against 12 defendants, including six police officers arrested on charges of attempting a coup while conducting the ABK investigation, as well as Sertçelik and those who helped him escape.

According to the indictment…

The Ankara Chief Public Prosecutor's Office issued detention orders for 16 suspects, including Sertçelik, on November 24, 2023, in connection with the murder of Mahfuz Tatar as part of the ABK investigation.

Five police officers went to Sertçelik's home.

Sertçelik had been shot at a soup restaurant on November 20 after violating his electronic monitoring bracelet to go out and have fun. Because of this, he was lying in bed with wounds to both legs.

It was decided that his statement would be taken at his home.

However, a doctor's report was required for this procedure.

On November 24, the police went to the Ankara Etlik City Hospital, where Sertçelik was being treated.

They asked Dr. Recep Emre Şişman to handwrite, "There is a medical objection to taking the individual into custody," on the consultation form dated November 20, 2023, with transaction number 6005535774. At the police's request, Şişman wrote, "There is a medical objection to taking the individual into custody," and stamped the form.

'WE DO NOT WANT TO TAKE HIM INTO CUSTODY'

In his statement, Şişman says the following:

"Two or three people who identified themselves as police officers came to me. They said there was a detention order for Sertçelik, that his treatment was being conducted in our department, and that the prosecutor's office had requested information on whether there was any medical objection to taking him into custody in his current state. The police said they were in a hurry as they had an hour or two, that the individual was already under house arrest and being kept under their supervision, that the prosecutor was aware of the situation, and that providing the report would not cause any legal trouble.

They even added, ‘The prosecutor knows, we don't really want to take this person into custody.’ Because I was facing state law enforcement officers and they stated the matter was urgent, I wrote my assessment note on the consultation form by hand, stamped it, and signed it. I had not included a phrase regarding detention in my initial note. However, an hour later, the same police officers came back to me and said, ‘Doctor, we want you to add the phrase that there is an objection to taking him into custody.’ I took a new printout and added the note to the form. This time, in line with the police's request, I also added the phrase, ‘There is a medical objection to taking the individual into custody.’"

HE WAS NOT CAPTURED DESPITE BEING IN ANKARA FOR 4 DAYS

Commissioner Gökhan Karaca was instructed to take Sertçelik's statement at home, taking the doctor's report into account.

His statement was taken on November 26.

Whatever happened...

It was requested that Sertçelik be brought to the Ankara Chief Public Prosecutor's Office by ambulance the following day.

However, when they went to his home on November 27, it was understood that he had fled.

According to the investigation, Sertçelik got into a vehicle and went to Mamak with his father, Erdoğan.

Adem Kaçan, who was also a fugitive, took Sertçelik to a housing complex in Eryaman by car on the same day.

Sertçelik made no moves until November 30.

He was not searched for or captured, despite being in Ankara for four days.

On December 1, he traveled to Istanbul at 18:15 in Ramazan Kubat's vehicle.

Sertçelik got out of the vehicle in Şile, in the area where the bungalows of his girlfriend, social media phenomenon Ece Ronay, were located.

He spent four days in Istanbul.

He fled abroad illegally on December 4, ‘using a route that could not be clearly determined.’

The indictment notes that although it was known that Sertçelik was in Istanbul, reports were filed stating he “could not be found.”

POLICE FAMILIARITY WITH THE SECRET WITNESS: 'MY SERDAR'

The indictment includes ambient and audio recordings made by the police.

One of these is the recording made by the police who visited Sertçelik at his home on November 24.

The police address Sertçelik as “My Serdar” and “My brother.”

In the conversation, Sertçelik notes that when the ABK case moves to the trial stage, he will go abroad with the identity that will be provided to him.

The dialogue between Sertçelik and the police is as follows:

Sertçelik: “Do you know why I'm scared now, brother? They might arrest me suddenly; my mother and father are here defenseless, my brother is defenseless. We've been left completely exposed.

Police: With God's permission, nothing will happen to you.

Sertçelik: I've already given up on going abroad. Because I understood, they won't send me abroad, brother.

Police: Why...

Sertçelik: This identity thing will happen this week. If it happens, the handcuffs will come off anyway, then I'll go directly... There are people I'm supposed to get some money from. I'll get the money from them, and then I'll go.”
