Acquittal for Aleyna Tutuş in the murder trial of footballer Kubilay Kundakçı

The incident occurred on the night of March 19 on Sıddık Street in Ümraniye. Allegedly, Vahap Canbay, a member of the rap group Canbay&Wolker, wanted to reconcile with singer Aleyna Tutuş, from whom he had separated some time ago. Canbay asked for help from his friend Kubilay Kaan Kundakçı, with whom he was on good terms. Kubilay Kundakçı went to the front of the studio where Aleyna Tutuş was located, accompanied by Vahap Canbay and their friends. While the group was waiting in the vehicle, they were allegedly attacked by suspects who arrived at the scene in luxury vehicles equipped with flashing lights. Kubilay Kundakçı was critically wounded when suspect Alaattin Kadayıfçıoğlu opened fire on the group inside the vehicle. The 21-year-old footballer, who was rushed to the hospital, could not be saved despite all interventions and lost his life.

The hearing held at the Istanbul Anatolian 27th High Criminal Court was attended by detained defendants Aleyna Tutuş, Alaattin Kadayıfçıoğlu, Hüseyin Can Avcı, Mustafa Rece, Metin Kadayıfçıoğlu, Ahmet Özkoç, and non-detained defendants Zuhal Kalaycıoğlu, Bilal Kadayıfçıoğlu, as well as the lawyers for both sides. Non-detained defendant İzzet Yıldızhan attended the hearing via the Audio and Visual Information System (SEGBİS), while the father of the deceased, Cemil Kundakçı, and his mother, Ülker Kundakçı, were also present in the courtroom.

In his opinion, the public prosecutor requested the release of Aleyna Tutuş regarding the charge of 'inciting intentional homicide' and that she be sentenced to up to 1 year in prison for 'failure to report a crime'. The prosecutor requested that Alaattin Kadayıfçıoğlu be sentenced to life imprisonment for 'intentional homicide' and that his detention continue.

"It is out of the question for me to incite anyone"

Detained defendant Aleyna Kalaycıoğlu stated, "It is out of the question for me to incite anyone in any way. In this incident, I did not say things like 'they are waiting for me' to Alaattin. I have a disabled sibling, and my entire responsibility is to look after them. Kubilay is like a brother to me. Am I the Antichrist? How could I want such a thing? I spent a year and a half with these people; how could I wish them harm? It was the first time in my life I saw a gun. With the psychological shock of seeing that gun, I felt as if boiling water had been poured over me. I didn't even think I would be arrested; I thought of myself as a victim of the incident."

"I would not have gone if I had known they were there"

Detained defendant Alaattin Kadayıfçıoğlu said, "I would not have gone if I had known they were there. I never had any intent. I am not that kind of person. On the day of the incident, I went to pick up her belongings at Aleyna's request. I became uneasy when I saw 3 people blocking the passage in the middle of the night. I asked Aleyna, 'Who are they?' She told me the person sitting in the passenger seat was her ex-boyfriend. Upon this, I went to the vehicle to talk; I was just going to tell them to leave. I took the gun to be a deterrent. When I went to talk, the gun went off accidentally in a split second when Canbay interfered with my hand. I don't even know Kubilay; why would I have such intent? I swear on my honor and dignity that I did not fire the gun."

"I have been innocent from the beginning"

Non-detained defendant Zuhal Kalaycıoğlu stated, "I swear that if I had known such a thing would happen, I would have done everything in my power to prevent it. I am a mother who has never been involved in any crime to this day and has lived as stably as possible. I have been innocent from the beginning. Very ugly slanders have been cast upon me, and I never accept them. I did not incite anyone. I condemn those who put my daughter and me in the crosshairs."

"I laid my 21-year-old child to rest"

Kubilay Kaan Kundakçı's mother, Ülker Kundakçı, said, "I laid my 21-year-old child to rest. They all owe me a life; I do not forgive any of them. They will carry my curse until they die. The biggest culprit is Aleyna. She was the one who brought Alaattin there."

Announcing its verdict, the court panel acquitted Aleyna Tutuş of the charges of 'inciting intentional homicide' and 'failure to report a crime', while sentencing Alaattin Kadayıfçıoğlu to life imprisonment for 'intentional homicide' and 2 years and 6 months in prison for 'violating the Firearms Law'. Engin Taşkıran was sentenced to 2 years and 1 month for 'aiding and abetting a criminal', Metin Kadayıfçıoğlu to a total of 5 years for 'concealing criminal evidence' and 'aiding and abetting a criminal', Mustafa Rece to 2 years and 1 month for 'concealing criminal evidence', and Hüseyin Can Avcı to 2 years and 1 month for 'concealing criminal evidence', with the court ordering their release under judicial control. The court panel also acquitted defendant İzzet Yıldızhan of 'aiding and abetting a criminal', defendant Zuhal Kalaycıoğlu of 'inciting intentional homicide', defendant Bilal Kadayıfçıoğlu of 'aiding in intentional homicide', and defendant Ahmet Özkoç of 'aiding and abetting a criminal'.
