Adnan Polat faces 'protected area' hurdle in Levent: Violates zoning plan!

In the Levent neighborhood of Beşiktaş, a notable development has occurred. 

Seventy-three citizens fighting against "zoning rent-seeking" have achieved a significant victory through a lawsuit they filed. The court has issued a stay of execution.

According to a report by İsmail Arı from BirGün; the construction project, which drew public outcry, was granted a permit by the Beşiktaş Municipality on December 29, 2022. A luxury residential project was initiated on the land belonging to Rönesans Fuarcılık Company by the company of former Galatasaray Sports Club President Adnan Polat. Citizens who filed a lawsuit with the Istanbul Administrative Court had requested the cancellation of the construction permit. The citizens emphasized that the construction project falls within the boundaries of the Bosphorus Protected Area Impact Zone and violates the zoning plan. It was stated that the project, which is claimed to be in violation of the Bosphorus Law and regulations, would consist of 9 basement floors, a ground floor, and 14 regular floors.

Emphasizing that "a special zoning privilege was granted to the company," the citizens stated in their petition: "Since the construction permit requested for cancellation has led the non-party company to begin construction and continue its activities, it is clear that irreparable damages will be caused to the plaintiffs. Indeed, this damage has already manifested itself; the non-party parcel owner has already occupied a portion of Altzeren Street and Ülgen Street, and the parking bays used by the plaintiffs and local residents have become unusable due to this occupation. Even at the time this petition was written, the parcel owner continues to occupy the street, extending beyond the parcel, and is 'erecting particleboard walls'."

EXECUTION STAYED

Furthermore, the citizens underscored in their petition that the project would cause irreparable harm. While the Beşiktaş Municipality requested the dismissal of the case, the court issued its ruling on April 24. In its decision, the court emphasized that the actions subject to the lawsuit were unlawful and issued a stay of execution.
