AKP's Tayyar warns government over 'Tayfun Kahraman ruling': It will lead to chaos, it would be a shame

On October 16, the Constitutional Court released its reasoned decision stating that the "Right to a Fair Trial" of urban planner Tayfun Kahraman, who has been imprisoned for nearly 4 years as part of the "Gezi Park Case," had been violated.

The High Court ruled that the guarantees stemming from the "Right to a Trial in Accordance with Equity" had not been upheld.

LOCAL COURT DISREGARDS TURKEY'S HIGHEST JUDICIAL AUTHORITY

However, the ruling of the Constitutional Court (AYM), which is Turkey's highest court, was not accepted by the Istanbul 13th High Criminal Court, which had sentenced Kahraman.

The court claimed that the AYM had "usurped authority" and rejected the request for a retrial.

TAYYAR REACTS SHARPLY TO THE RULING

AKP member Şamil Tayyar reacted sharply to the local court's disregard for the AYM, Turkey's highest judicial authority. Stating that the Istanbul 13th High Criminal Court's decision was "clearly unlawful," Tayyar called on the Council of Judges and Prosecutors (HSK) to launch an investigation into this local court.

Şamil Tayyar used the following expressions in his post:

"The Istanbul 13th High Criminal Court accusing the Constitutional Court of usurping authority and disregarding the retrial decision regarding Tayfun Kahraman is a very clear and explicit unlawful decision.

As clearly stated in the Constitution, AYM decisions are final.

If a local court challenges the AYM and disregards its decisions, it causes the greatest harm to Turkey.

The HSK must place this local court under investigation.

Both the AYM and the government must follow up on this.

This is not a simple or ordinary incident.

If the Constitution is shelved and every institution attempts to create its own special law, irregular elements will rule the country, it will lead to chaos, it would be a shame.

Turkey does not deserve this."
