Another lawsuit filed against Emine Ayna, who was ordered to be released in the Kobani Case

Within the scope of a terror investigation, a lawsuit has been filed against former Democratic Regions Party (DBP) Co-Chair Emine Ayna, seeking a prison sentence of 7 years and 6 months to 15 years for the crime of "membership in an armed terrorist organization."

The indictment prepared by the Diyarbakır Chief Public Prosecutor's Office against the non-detained defendant Ayna has been accepted by the 4th High Criminal Court.

The indictment includes detailed information regarding the establishment, structure, and attacks of the armed terrorist organization PKK/KCK.

The indictment, which recalls that suspect Ayna did not have legislative immunity as she was not elected as a member of parliament in the 25th term general elections, states that the Chief Public Prosecutor's Office conducted work targeting terrorist organizations and terrorists operating on behalf of the organization, and that palm and fingerprints were identified through materials seized.

The indictment reports that an investigation was launched after an expert report dated October 5, 2020, determined that a fingerprint obtained from various torn pieces of paper matched that of suspect Emine Ayna.

The indictment notes that while the investigation into Ayna was ongoing, another investigation file was sent to the Diyarbakır Chief Public Prosecutor's Office from the Ağrı Chief Public Prosecutor's Office with a decision of lack of jurisdiction, and states: "Following the local elections on March 29, 2009, the terrorist organization PKK/KCK issued calls for the public to show resistance through its affiliated media outlets. Upon these calls, the suspect went to Ağrı and gave a speech at the Democratic Society Party (DTP) building."

The following was recorded in the evaluation and conclusion section of the indictment:

"As a result of the work carried out targeting terrorist organizations and organization members operating on behalf of terrorist organizations within the scope of the Diyarbakır Chief Public Prosecutor's Office's investigation files numbered 2007/996 and 2007/1776, for which investigations were completed, trials were held for certain suspects whose palm and fingerprints were identified on materials seized during the examinations.

Examinations conducted within the scope of the investigation determined that a fingerprint obtained from various torn pieces of paper matched that of suspect Emine Ayna. Furthermore, the suspect went to Ağrı in line with the calls of the terrorist organization and gave a speech there. It is understood that there is sufficient evidence to file a public lawsuit against the suspect for the crime of membership in an armed terrorist organization, which is attributed to her actions. It is requested and claimed on behalf of the public that the suspect be sentenced for the crime she is charged with."

In the indictment, a prison sentence of 7 years and 6 months to 15 years is requested for Ayna for the crime of "membership in an armed terrorist organization."
