Appeal against Ahmet Özer's arrest rejected! Court denies the objection: The reason has been revealed

According to the report by Anka, the reasoning of the court that rejected the appeal against the arrest of Esenyurt Mayor Prof. Dr. Ahmet Özer, who was arrested and replaced by a trustee, has been revealed.

In the justification provided by the 11th Criminal Court of First Instance, which rejected the appeal on the same day, it was stated that the actions mentioned in the statement of the secret witness within the scope of the investigation were newly obtained.

APPEAL REJECTED: THE REASON HAS BEEN REVEALED

The justification stated the following:

"Even considering that, according to Article 9/8 of the Witness Protection Law, the statement of a secret witness cannot be taken as the sole basis for a verdict, given that the actions mentioned in the secret witness's statement could not have occurred without a specific organic link or representation relationship with the organization as explained above—in other words, considering that the actions in question, if proven, contain detailed and concrete explanations regarding person, time, and place elements by their nature—it can be seen as sufficient on its own to establish the alleged crime. Under these circumstances, it can be characterized as concrete evidence showing the existence of a strong suspicion of a crime at this stage. Considering that the actions mentioned in the secret witness's statement were newly obtained according to their timing, that there is other evidence that needs to be collected, and that the time spent in detention is proportionate at this stage given the lower and upper limits of the penalty prescribed by law for the crime the suspect is charged with, it has been decided that there is no reason to change the decision. Therefore, the objection of the suspect's defense attorneys is rejected, the decision shall be notified to the relevant parties by the Istanbul Chief Public Prosecutor's Office, and the file shall be returned to the Istanbul Chief Public Prosecutor's Office for necessary action; this decision is final as a result of the examination conducted on the file."
