Appeal filed in Narin Güran murder case regarding Nevzat Bahtiyar
In the case concerning the murder of 8-year-old Narin Güran in Diyarbakır, an appeal has been filed with the Regional Court of Justice against the 4-year and 6-month prison sentence handed down to defendant Nevzat Bahtiyar for the crime of "destroying, concealing, or altering criminal evidence."
The Diyarbakır Bar Association has submitted an appeal petition to the 8th High Criminal Court, where the trial was held, to be forwarded to the Diyarbakır Regional Court of Justice.
The petition recalls that in the verdict hearing held at the Diyarbakır 8th High Criminal Court on December 28, 2024, a case was opened against neighbor Nevzat Bahtiyar, who confessed to hiding Narin Güran's lifeless body in the stream, for the crime of "intentional killing of a child in complicity," and notes that the defendant was sentenced to 4 years and 6 months in prison for the crime of "destroying, concealing, or altering criminal evidence."
The petition, which states that they have applied for the appeal process in the capacity of a plaintiff on the grounds that the local court's characterization of the crime regarding defendant Bahtiyar was erroneous when considering the evidence in the file, notes that there is significant evidence in the file showing that Bahtiyar participated in the act of killing Narin as a joint perpetrator.
The petition states, "Given that the fact that the defendants were present at and around Arif Güran's house at the time of the incident is established by reports and the court's reasoned decision, it is clearly seen that the defendant was also involved in the incident through the unity of place and time.
In view of the fact that the intent of complicity of all defendants is established within the scope of the file both during and after the incident, the local court's disregard of this matter and the exclusion of Bahtiyar from the 'intentional killing' charge has caused the verdict to be contrary to the law."
The conclusion and request section of the petition stated the following:
"Nevzat's intent of complicity should be accepted and he should be punished as a joint perpetrator. For these reasons, the decision of the Diyarbakır 8th High Criminal Court dated December 28, 2024, should be re-evaluated as a result of the appellate review regarding Nevzat Bahtiyar, and the verdict given against the defendant for the crime of 'destroying, concealing, or altering criminal evidence' should be overturned and he should be sentenced in accordance with Article 82/1-d-e of the Turkish Penal Code (TCK) No. 5237, just like the other defendants. We request that our appeal be accepted and that defendant Nevzat Bahtiyar be sentenced for the crime of 'intentional killing of a child in complicity'."
In the verdict hearing held at the Diyarbakır 8th High Criminal Court on December 28, 2024, detained defendants mother Yüksel, brother Enes, and uncle Salim Güran were each sentenced to aggravated life imprisonment for the crime of "intentional killing of a child in complicity," while Nevzat Bahtiyar was sentenced to 4 years and 6 months in prison for the crime of "destroying, concealing, or altering criminal evidence," and the 944-page reasoned decision was announced on January 23.
The Diyarbakır Chief Public Prosecutor's Office had also previously filed an appeal with the Regional Court of Justice against the 4-year and 6-month prison sentence imposed on Nevzat Bahtiyar for the crime of "destroying, concealing, or altering criminal evidence."
