At the beginning of the hearing, when Bora Kaplan asked for the floor to make a statement regarding the "my one and only" (bir tanem) issue, the following dialogue took place:
Presiding Judge: Ah, that matter. I know, it has been in the news quite a bit. I didn't even notice it. Or rather, I forgot. You mentioned it in the first session and apologized repeatedly. It's a strange thing. We know who says what and with what intention. If it were said with a different intention, we would do what is necessary.
Bora Kaplan: They don't say, "Look how sincere this man was, he got carried away while explaining." Still, I apologize to you, to your office, and to everyone in front of the public. I have a criminal record, I have a history; but I have never shown any disrespect to the state in my life, and I never will. So much was done while I was in custody, I didn't offer any resistance. One needs to be a bit fair.
When Kaplan continued by saying that the concept of secret witnesses should be abolished, the Presiding Judge replied, "Let's hear your legal opinions later," and added, "We have received your apology, we have accepted it."
While defendant Barış Kurt was making his request for release, he reiterated that the HTS (Historical Traffic Search) report prepared by the expert witness did not reflect the truth, and that another report they had obtained revealed that the statements of the complainant Erkan Doğan were not accurate, and said the following:
"Don't believe it, but for God's sake, take a look. Our paths and our ways do not cross with Erkan Doğan. After what I explained last time, they corrected Erkan Doğan's statements. If he makes a correction after what I explain today, I will not forgive any of you."
SOME PEOPLE'S LUST FOR SEATS AND MONEY
Barış Kurt, a former AKP Ankara Provincial Deputy Chairman and Çankaya Municipal Council Member, explained the reason for what happened as follows:
"It happened because of some people's concern for seats and their lust for money. Erkan Doğan has 34 files just in Samsun and Ankara, not to mention İzmir. An organization file was created in 2018 and closed in 2020. I am not in that file, nor in this incident. If it is so important, why wasn't I included? If I wasn't in this organization in 2018, how did I join later? If I had sold out Bora Kaplan and others on the first day, if I had given the names they wanted, these things wouldn't have happened to me. They mounted me into this file for the sake of a seat, to reach certain people. Don't let me get caught in the middle for some people's lust for seats and money. I am not a random man. Why did you seize my company, which has nothing to do with Bora Kaplan? Why are you ruining me?"
Barış Kurt noted that Bora Kaplan definitely does not know Süleyman Soylu, is not acquainted with him, their paths have never crossed, and there is not a single photograph of them together.
Kurt also explained that when he was taken into custody, the police tore up the license of the weapon they took from his car just to be able to say, "A weapon was seized," and that when a lawsuit was filed against him for possessing an unlicensed weapon, it was seen that his weapon was licensed, adding, "They are in such a desperate and helpless state."
Kurt's lawyer, Nazmi Kobal, also stated that during the interview in custody, the police told his client, "Because of your previous position, what you say will be more convincing and binding than the others, so name these people," but that Kurt refused this, and they would file a criminal complaint against those police officers.
Kurt's other lawyer, Muhammet Hardalaç, while making a request for release including the electronic monitoring application, emphasized that after the secret witness M7 Serdar Sertçelik incident, he believed the police would not allow his client to move from the courtroom to the room.
AYHAN BORA KAPLAN HAS FILED A CRIMINAL COMPLAINT AGAINST POLICE OFFICERS
The afternoon session of the hearing began with the defense of Bora Kaplan's lawyers. Attorney Tarık Teoman pointed out the oddities in Kaplan's detention and the problems in the file, noting that perception had overtaken reality, and said, "If you watched the footage of the detention, you would have seen that there are serious differences between the actual situation and the official report." He announced that Kaplan had filed a criminal complaint with the Ankara Chief Public Prosecutor's Office on May 14 against the police officers who carried out the operation, and that the investigation is ongoing.
Attorney Teoman stated that it had emerged that the statements of the two secret witnesses and the witness named C.K., which formed the basis of the indictment, were obtained through coercion and direction, and said that this indictment was now null and void.
Kaplan's other lawyer, Umut Köroğlu, argued that Kaplan's detention was illegal, and stated that the expert who prepared the report on the HTS records was a police officer who had left the KOM (Anti-Smuggling and Organized Crime Department) a short time ago, and that he had falsified the base station records, requesting that a criminal complaint be filed against the expert for forgery of documents.
Attorney Köroğlu, who called on the Presiding Judge, "Please help us against public pressure and this setup," said that the trial of the very comprehensive money laundering file should also be conducted together with this case.
Kaplan's third lawyer, Rıdvan Şahin, referring to the statements of KOM Branch Manager Kerim Gökay Öner, said, "He talks about such rot that, if it were me, I wouldn't let anyone working at KOM through the doors of the Police Department ever again." Attorney Şahin also shared this interesting development:
"The police send us documents without us even requesting them; we are talking about something in the meantime, and the document arrives. Look, on May 18, someone called from the Syrian line and said, 'Bora Kaplan has escaped from prison and is currently on his way to Italy.' The police called the prison and asked, 'Is Bora Kaplan there?' and a report was drawn up, and this was sent to the file. Do you know how this will be reflected in the media? They will say, 'Bora Kaplan was going to escape, the police prevented it.'"
While Attorney Şahin stated that there were reports in the media saying "Those complainants have withdrawn," he said, "No, this is not true. Those complainants have no value for us. We have only one complainant: The Police. And they haven't withdrawn either, they are still sitting here."
