Banu Parlak's beauty center was shot at: Flash development in the case where Dilan Polat and Engin Polat were acquitted!

The prosecutor's office has appealed the acquittal of the defendants, including Dilan, Engin, and Sezgin Polat, in the case regarding the armed attack on social media influencer Banu Parlak's beauty center.

In the appeal petition submitted by the Küçükçekmece Chief Public Prosecutor's Office to the Küçükçekmece 3rd Criminal Court of First Instance to be forwarded to the Istanbul Regional Court of Justice (Appellate Court), it was stated that a conviction should have been handed down against defendants Dilan, Engin, and Sezgin Polat for "inciting the crime of armed threat by more than one person," and that the acquittal decision was erroneous.

In the prosecutor's petition, it was emphasized that the acquittal decision was unlawful, and it was noted that there was hostility between the complainant Banu Parlak and the defendant Dilan Polat prior to the incident, and that Parlak had submitted threatening messages to the case file. It was recorded that due to this hostility, Dilan, Engin, and Sezgin Polat contacted Beratcan Gökdemir and his brother Batın Can Gökdemir, fugitive leaders of the organized crime group known publicly as the "Daltonlar Gang," to organize an armed attack on the complainant's workplace.

The petition stated that gang leader Beratcan Gökdemir gave instructions to Batuhan İnci, Yunus Emre Yıldız, Nizamettin Bilgili, Onur Abiç, and İsmail Emre Arifoğlu, who were waiting in a safe house linked to the "Daltonlar" group, and shared the address where the motorcycle and weapon to be used in the attack would be delivered, as well as the location of the "Banu Parlak Beauty Center."

The petition emphasized that the defendants who carried out the attack had no personal hostility toward the complainant, and stated that the organized crime group carried out the attack following Dilan Polat's threats against Parlak, and that two separate armed attacks were carried out on the workplace on the same day.

THREATENING MESSAGES AND OTHER EVIDENCE

In the prosecutor's appeal, it was determined that "considering the complainant's statement, witness testimony, defendant Dilan Polat's social media posts containing threats directed at victim Banu Parlak, examinations of digital materials, the confession-like statements of some defendants, the crime scene investigation report, the forensic expert report, and police reports; Engin, Dilan, and Sezgin Polat committed the crime of 'armed threat by more than one person' by inciting the organized crime group."

The petition, which recalled that Banu Parlak had withdrawn her complaint against the defendants, stated that the crime of armed threat is not subject to a complaint, and therefore the defendants should be punished. It was argued that the acquittal decision was contrary to procedure and law, and the reversal of the decision was requested.

APPEAL AGAINST LIGHTER SENTENCES

The appeal petition also stated that Batuhan İnci, Nizamettin Bilgili, Yunus Emre Yıldız, and İsmail Emre Arifoğlu were sentenced from the lower limit for the crimes of "being a member of an organization established to commit crimes" and "violating the Law on Firearms No. 6136," and that the sentences should have been heavier considering the manner in which the crime was committed, the place and time it was committed, the defendants' intent, and other aggravating circumstances.

LEGAL PROCESS

The Küçükçekmece Chief Public Prosecutor's Office had filed a lawsuit against 11 defendants, including Dilan, Engin, and Sezgin Polat, on the allegation that Dilan Polat had ordered an attack on Banu Parlak's workplace.

The Küçükçekmece 3rd Criminal Court of First Instance acquitted Dilan, Engin, and Sezgin Polat, who were being tried without arrest, of "inciting the crime of armed threat by more than one person," while ruling that the charge of "inciting property damage" should be dropped on the grounds that it was subject to a complaint.

While the court also acquitted defendant Onur Abiç, it sentenced Batuhan İnci and Nizamettin Bilgili, who were being tried under arrest for "membership in an organization" and "armed threat by more than one person," to 5 years and 6 months in prison, and Yunus Emre Yıldız and İsmail Emre Arifoğlu to 4 years and 7 months in prison.

In addition, the court decided to release the 5 defendants who were under arrest and separated the files of the fugitive defendants Barış Boyun, Beratcan Gökdemir, and Batın Can Gökdemir.
