Breaking News: Interim ruling announced in the Ayhan Bora Kaplan case! 2 people released...
An interim ruling has been announced in the Ayhan Bora Kaplan case. The court decided to release defendants Furkan Anıl Bahar and Arif Buğra Beşe.
The interim ruling has been announced in the Ayhan Bora Kaplan case, which has dominated Turkey's agenda and caused an earthquake within the Ankara Police Department.
The hearing for the case against 61 people, 20 of whom are in custody, regarding the Ayhan Bora Kaplan criminal organization continued at the Sincan Prison under the Ankara 32nd High Criminal Court.
It was decided to release defendants Furkan Anıl Bahar and Arif Buğra Beşe.
The next hearing has been adjourned until September 9.
12punto columnist Müyesser Yıldız reported the events at the hearing as follows;
The case, heard by the Ankara 32nd High Criminal Court at the Sincan Prison complex, began with the statements of the lawyers for defendant Mahmut Gökhan Çanga. Stating that his client is accused of killing Semih Arslan, Attorney Mert Doğan reminded that two secret witnesses who made this claim had retracted their statements, and that the other witness had stated that he was directed by the police. Attorney Doğan alleged that he encountered the well-known commissioner who took Mahmut Gökhan Çanga's statement at the courthouse 15 days later during another operation, and that after the commissioner asked about Mahmut Gökhan Çanga, he said, "Actually, we know that this case is not a murder."
Çanga's other lawyer, Ela Leyla Umur, also stated that this case had turned into a free-for-all, saying, "Secret witness M7 announced that this was a fabrication. Ü5 reported that he was subjected to duress and violence. Police officers were arrested. Audio recordings emerged. Even the KOM Director confessed. What are we talking about here?"
Stating that the Presiding Judge said, "We do not give credence to rumors," while chatting two days ago, Attorney Umur said the following:
"Yes, we are saying the same thing. Here, there is not even abstract evidence, let alone concrete evidence. We have understood that some people have been conducting this business in line with their political and personal goals. This operation has backfired on them, and they themselves have been put inside. Are we going to give credence to these rumors or not?"
After the lawyers' statements were completed, the Prosecutor, when asked for his opinion, requested that the detention of the defendants in custody and the judicial control measures for the defendants released pending trial continue, that the arrest warrants for fugitive defendants, primarily Serdar Sertçelik, be awaited, that the complainants' requests to join the case be accepted, and that the complainants who did not attend the hearing be brought by force.
The panel adjourned the hearing for deliberation on the decision.
After the break, the Presiding Judge announced that it had been decided to release Arif Buğra Beşe and Furkan Anıl Bahar.
Before the Judge announced the decision, Bora Kaplan's lawyer, Umut Köroğlu, took the floor and stated that the arrested commissioner, Ufuk Gültekin, confessed that they took the statements of the secret witness codenamed M7, Serdar Sertçelik, at the Police Department and sent them to the prosecutor as a PDF, adding, "This confirms our statements."
The other interim rulings are as follows:
"Continuation of the international travel ban judicial control measure for defendants released pending trial... Acceptance of the complainants' requests to join the case... Awaiting the execution of arrest warrants for Serdar Sertçelik and other fugitive defendants... Issuance of an arrest warrant for complainant Murat Yener, who did not attend the hearing... Abandoning the hearing of Muhammet Sağ, who fled abroad and whose address cannot be found... Conducting a crime scene investigation on May 29 at the house where Semih Arslan, who is alleged to have been murdered, stayed..."
After the decision, the relatives of the defendants reacted to the panel and the journalists, while the hearing was adjourned until September 9.
