Call for 'probation' reform from MHP's Feti Yıldız
MHP Deputy Chairman Feti Yıldız emphasized the need for a new regulation regarding probation, stating, "The date of the crime should be taken as the basis, and this injustice, which contradicts the principle of equality, must be resolved."
With the regulation adopted by the Grand National Assembly of Turkey (TBMM) during the coronavirus pandemic, well-behaved convicts who were on Covid-19 leave and had a certain amount of time remaining until their conditional release date were able to complete the remainder of their sentences under probation.
As of July 31, 2023, a new practice was initiated for convicts on Covid-19 leave who had five years or less remaining until they would be eligible for probation, and it was decided that these individuals could serve their remaining time under probation without needing to return to prison.
MHP Deputy Chairman and Istanbul MP Feti Yıldız, in a statement regarding the issue, stated that the current regulation leads to injustice, argued that the date of the crime should be taken as the basis, and called for a new legal regulation.
Yıldız noted the following:
“The debate over whether the Probation Regulation issued in July 2023 during the COVID-19 pandemic violates the constitutional principle of equality has never ended. Hundreds of people call me every single day. The regulation enabled those with five years or less remaining until their probation eligibility to serve their remaining time under probation.
This regulation, which covered those whose sentences were finalized before July 31, 2023, did not cover those who committed crimes before the same date but whose sentences had not yet been finalized. As we have stated many times in the TBMM; of two people who received the same sentence, one's sentence was finalized before July 31, 2023, while the other's could not become a final judgment due to delays in legal remedies.
Is there any fault to be attributed to the defendant due to delays occurring in legal remedies? A new regulation should be made, the date of the crime should be taken as the basis, and this injustice, which is also contrary to the principle of equality, should be eliminated.”
