Cem Aydın to pay 60 thousand TL in compensation to Akın Gürlek
The Istanbul 44th Civil Court of First Instance has ruled that CHP Youth Branches Chairman Cem Aydın must pay 60 thousand TL in compensation in a non-pecuniary damages lawsuit filed by Deputy Minister of Justice Akın Gürlek.
CHP Youth Branches Chairman Cem Aydın had faced legal proceedings following the resharing of a video titled "Anatomy of a Mobile Guillotine: Akın Gürlek" on social media. Following the investigation launched due to this post, Aydın was brought from Ankara to Istanbul on January 20 to provide his statement.
The accusations directed at Aydın included "insulting a public official due to their duty" and "targeting individuals involved in the fight against terrorism." In the prepared indictment, a prison sentence ranging from 2 years and 2 months to 5 years and 4 months was requested for the CHP youth leader, along with a political ban.
In the hearing held last week at the Istanbul 14th High Criminal Court, the court panel sentenced Cem Aydın to 1 year, 5 months, and 15 days in prison for the crime of "insult," and deferred the announcement of the verdict. He was acquitted of the "targeting" charge. It was decided that Aydın's travel ban would be lifted once the decision becomes final.
While the process was ongoing, Akın Gürlek also filed a lawsuit against Aydın in a civil court, demanding 100 thousand TL in non-pecuniary damages. The petition stated, "Due to the distress suffered by the plaintiff client Akın Gürlek as a result of the insults and unfair accusations, we request the collection of 100 thousand TL in compensation from the defendant along with interest, and that the litigation expenses and opposing attorney fees be left to the other party."
In the case concluded today, the Istanbul 44th Civil Court of First Instance partially accepted the compensation request and ruled that Cem Aydın must pay 60 thousand TL in non-pecuniary damages.
