Cem Uzan's application in France rejected: TMSF found to be in the right

The Paris Court of Appeal has rejected the appeal filed by Cem Uzan against the decision regarding the collection of claims by the Savings Deposit Insurance Fund (TMSF).

As part of the legal proceedings conducted in France to track the Uzan Group's assets abroad and collect public receivables, the TMSF had applied to the judiciary with a request for the recognition and enforcement of the decision rendered by the Istanbul 2nd Commercial Court of First Instance against Cem Cengiz Uzan and Murat Hakan Uzan. Previously, the Paris Judicial Court had ruled for the enforcement of the decision in question.

The Uzan brothers took this decision to the Paris Court of Appeal. However, in its decision dated February 3, 2026, the court rejected the appeal. The ruling emphasized that the TMSF has the authority to request the collection of receivables, that Turkish courts are competent in the dispute, and that there is no situation contrary to the principles of a fair trial in the Turkish proceedings.

According to reports by Habertürk, with this decision, the obstacles to the collection process for the receivables in favor of the TMSF, amounting to 4 million 22 thousand 791.96 US dollars, 1 million 667 thousand 948.70 euros, 7 thousand 7.84 pounds sterling, and 14 thousand Swiss francs, have been removed.

The Uzans may file an appeal with the Cour de Cassation within two months from the notification of the decision to them. However, a potential appeal process will not stay the execution of the receivables, which amount to approximately 19 million dollars including interest.
