Chief Public Prosecutor's Office responds to CHP's Murat Emir's claim that 'Hüseyin Gün was disappeared': He was held at police headquarters for 4 days

An "espionage" investigation has been launched by the Istanbul Chief Public Prosecutor's Office into Istanbul Metropolitan Municipality (IBB) Mayor Ekrem İmamoğlu, TELE 1 Television Editor-in-Chief Merdan Yanardağ, and İmamoğlu’s advisor and campaign director Necati Özkan.

Within the scope of the investigation, Merdan Yanardağ was detained, and searches were conducted by police at his home and the TELE1 building. Hüseyin Gün became the key figure in the prosecutor's investigation, which uses the phrase "Ekrem İmamoğlu criminal organization." It was learned that the key figure, Gün, provided a detailed statement with a request to benefit from effective remorse provisions. Gün, who gave a 262-page statement to the police, was sent to prison after being arrested on July 4.

The Istanbul Chief Public Prosecutor's Office issued a statement regarding the remarks made by Emir about Hüseyin Gün, who is benefiting from 'effective remorse' in the 'espionage' investigation, in which he asked, "Where did you take him from his cell, and what statements were you forcing him to give?" Stating that the allegations do not reflect the truth, the Chief Public Prosecutor's Office noted that Gün was sent to prison after his procedures were completed.

The Chief Public Prosecutor's Office stated the following in its announcement:

"A need has arisen to make a statement regarding the subject following the disinformation-laden remarks made today by Murat Emir, a Group Deputy Chairman and Member of Parliament for the Republican People's Party (CHP), in his speech at the Grand National Assembly of Turkey, concerning the investigation conducted by our Chief Public Prosecutor's Office into the espionage activities of the Ekrem İmamoğlu Profit-Oriented Criminal Organization, in which he claimed that suspect Hüseyin Gün, who is currently detained for espionage, was 'taken from the penal institution and did not return for three days, that his whereabouts were unknown, that he was disappeared, and that these procedures were carried out without an official investigation or his lawyer present.'

Accordingly;

Within the scope of the ongoing investigation, after the aforementioned suspect was previously arrested for espionage, it was determined upon examination of his data that he had engaged in actions within the scope of the activities of the aforementioned criminal organization, and it was decided to detain him for the crime of being a manager of a criminal organization.

Article 92/2 of Law No. 5275 states: "In cases deemed necessary for the verification of information obtained regarding crimes committed within the framework of terrorism and organizational activities, convicts or detainees may be taken from the penal institution for temporary periods upon the request of the relevant authority and the Chief Public Prosecutor's Office, and with the decision of a peace judge, provided that their consent is obtained. These periods are determined by the judge according to the nature of the case after the convict or detainee is heard, not to exceed four days each time and fifteen days in any case, and are counted as time spent in conviction or detention. The health status of the convict or detainee is determined by a doctor's report upon departure from and return to the penal institution. A copy of the documents regarding the procedures performed during the site visit is sent to the Chief Public Prosecutor's Office to be kept in the individual's file."

In accordance with this regulation, following the suspect's connection via SEGBIS to the Penal Institution where he is detained and his consent being obtained, and pursuant to the decision of the Istanbul 12th Criminal Court of Peace dated 23/10/2025, which granted permission for the suspect to be taken from the penal institution for a period of 4 (four) days for the first time starting from 24/10/2025 and to be held at the Istanbul Provincial Police Department Anti-Terrorism Branch, the suspect's exit procedures from the penal institution were carried out and his delivery to the Police Department was ensured.

The suspect, who was in custody, provided information about the espionage activities of the aforementioned organization in his statements taken by the police and our office with a request to benefit from effective remorse provisions based on additional evidence obtained within the scope of the investigation regarding the crimes of being a manager of a criminal organization and espionage, and upon completion of his procedures, he was sent back to the Penal Institution where he is detained."
