Civil Servants Law proposal accepted
The Law Proposal on Amendments to the Civil Servants Law and Certain Laws and Decree-Laws, which also includes regulations regarding civil servants, has been accepted and enacted by the Grand National Assembly of Turkey (TBMM) General Assembly.
Negotiations were held in the TBMM General Assembly on the Law Proposal on Amendments to the Civil Servants Law and Certain Laws and Decree-Laws.
At the end of the negotiations, the proposal was accepted and enacted. The regulation, which allows civil servants who have not received any disciplinary punishment for 8 years to benefit from an additional grade advancement, will also apply to those who have transitioned from contract status to civil servant positions within the framework of the Civil Servants Law and the Law on Amendments to Certain Laws and Decree-Law No. 663.
Those who were removed from managerial positions within the scope of the relevant articles of Decree-Law No. 375, or whose duties in these positions ended and were appointed to relevant staff positions, and who subsequently resigned from civil service of their own volition while in these positions and wish to return to civil service, will be appointed to the positions they left, provided that a security investigation is conducted on them and without seeking other conditions included in this provision, not to exceed 2 times, and without the need for any further procedure.
Unpaid leave for up to 3 years may be granted for the duration of their assignment to the spouses of civil servants who are assigned to international organizations of which Turkey is a member, or who work in the overseas units of public capital institutions or organizations, or who are assigned abroad for more than 6 months from among those working in these institutions and organizations.
Those appointed as assistant specialists will be entitled to take the proficiency exam, provided that they work for at least 3 years and that the specialization thesis they prepare on subjects to be determined by the units where they are employed is accepted by the thesis jury to be formed. For those who were entitled to take the proficiency exam under the provisions of the Law before the regulation was amended and for whom the first proficiency exam has not yet been held by their institutions as of the date this provision enters into force, the 6-month period envisaged for the conduct of said exam will begin from the date the article enters into force. The Ministry of Treasury and Finance will be authorized to declare a force majeure state.
Regulations are being made regarding the Presidential Administrative Affairs Directorate. Promotions of those in the judge and prosecutor class will be made on time, exceptionally, without the need for any other procedure.
Staff members whose services are no longer needed will be appointed to positions suitable for their status in other public institutions and organizations. The relevant organizations will carry out the procedures regarding the appointment as soon as possible within the framework of general provisions.
Personnel assigned for a fixed term whose services are no longer needed may be sent back to their institutions before the end of their term or their employment may be terminated.
Judges and prosecutors, district governors, legislative experts, and those who have been or are currently in central organization staff or positions that have the same or similar qualifications as those who have been admitted to the profession, trained, and qualified after a certain training program, and who are currently serving as rapporteurs in the status of fixed-term personnel tied to a staff position at the Presidential Administrative Affairs Directorate as of the date of publication of this provision, may be appointed to Presidential Rapporteur positions if they have served for at least 3 years and upon their favorable interview.
The revenues of the Turkish Statistical Institute (TÜİK) are being determined. Accordingly, TÜİK revenues consist of: Treasury grants, sale and leasing of movable and immovable property, all kinds of donations, aid, bequests, and other income that will not affect the impartiality or independence of the institution, project and research income, and other income.
A revolving fund of 150 million TL is being allocated for the purpose of fulfilling the duties of the General Directorate of the Mint and Stamp Printing House.
With the amendment made to the Special Consumption Tax Law, vehicles for the disabled will be able to be replaced every ten years. The vehicles will be required to be 20 percent domestic. Debts prior to January 1, 2015, for General Health Insurance will be canceled.
