Coming to the TBMM agenda: 'Espionage' crime to be added to the TCK with the new Judicial Package

AKP Group Chairman Abdullah Güler has completed work on the legislative proposal, known in the public eye as the "9th Judicial Package," which includes various regulations in the field of justice.

ESPIONAGE REGULATION

With the proposal, a new crime will be established in the TCK to effectively combat espionage activities.

A new article will be added to the "Crimes Against State Secrets and Espionage" section of the TCK. This article will be placed after Article 339 of the law, titled "Possession of documents related to state security," under the title "Committing crimes against the security or political interests of the State."

Accordingly, those who commit crimes against the security or domestic or foreign political interests of the state in line with the strategic interests or instructions of a foreign state or organization, outside of the "procurement or disclosure of documents and information" already sanctioned in the relevant law, will be sentenced to imprisonment from 3 to 7 years. The perpetrator may be sentenced separately for both this crime and the related crime committed.

If the act is committed during wartime or has endangered the state's war preparations, war effectiveness, or military operations, the perpetrator will be sentenced to 8 to 12 years in prison.

If the crime is committed by those working in units, projects, facilities, and institutions that perform services of strategic importance in terms of national security, the sentence will be increased by one fold.

Prosecution for this crime will be subject to the permission of the Minister of Justice.
