Competition Authority fines two companies

The Competition Authority has concluded its investigation into certain companies and associations operating in the construction chemicals market in Turkey. As a result of the investigation, which examined whether Article 4 of the Law on the Protection of Competition No. 4054 had been violated, a total of 42.7 million TL in administrative fines was imposed on two companies.

RECORD FINES FOR TWO COMPANIES

According to the decision taken at the Competition Board meeting on May 22, 2025:

Mapei Yapı Kimyasalları İnşaat San. ve Tic. AŞ was fined 31,332,351.95 TL for determining the resale prices of its distributors and implementing regional/customer restrictions,

Chryso-Kat Katkı Malzemeleri San. ve Tic. AŞ was fined 11,418,569.29 TL for similar practices of determining sales prices, implementing regional/customer restrictions, and imposing non-compete obligations on buyers.

DECISION REGARDING OTHER COMPANIES IN THE INVESTIGATION

No findings of competition violations were found regarding the other companies examined within the scope of the investigation. The companies that were investigated but found not to have committed any violations are as follows:

It was decided that there was no need to impose administrative fines on these companies.

Furthermore, no findings of any violations were found regarding the Concrete and Mortar Chemical Additives Manufacturers Association (KÜB) and the Construction Products Manufacturers Federation (YÜF).

INDIVIDUAL EXEMPTION GRANTED FOR DATA SHARING

A notable decision was made regarding the data-sharing practice conducted by KÜB within the scope of the investigation. Regarding the sharing of collected statistical data with KÜB members, YÜF, and relevant federations in Europe, it was decided:

Not to issue a negative clearance certificate under Article 8 of Law No. 4054,

However, to grant an individual exemption under Article 5 of Law No. 4054 for the data-sharing practice, provided it is conducted in a digital environment through an independent enterprise and with the participation of at least five members.
