Constitutional Court's 'Guitar' ruling published in the Official Gazette: Convict found in the right, compensation to be paid

The Constitutional Court has ruled that the right to the protection of the material and moral existence of a convict, whose access to their guitar in prison was blocked, was violated, and ordered the payment of 3,000 TL in compensation.

The Constitutional Court's ruling stating that the right to the protection and development of material and moral existence was violated due to a convict not being given their guitar in a penal institution has been published in the Official Gazette.

The convict at the Bandırma Closed Penal Execution Institution filed for compensation for the violation of rights, stating that the practice of the Penal Institution, which did not allow the guitar on the grounds that there was already an instrument in the ward, was incorrect. The Constitutional Court found the convict to be in the right.

Accordingly, the Constitutional Court unanimously decided to accept the request for legal aid, that the right to the protection and development of material and moral existence guaranteed under Article 17 of the Constitution was violated, that a net 3,000 TL in non-pecuniary damages be paid to the applicant, that the payment be made within four months from the date of the applicant's application to the Ministry of Treasury and Finance following the notification of the decision, and that legal interest be applied for the period until the payment date.
