Convention crisis in CHP continues: New move from Lütfü Savaş and delegates
Former Hatay Metropolitan Municipality Mayor Lütfü Savaş and former CHP convention delegates have taken the local court's decision regarding the CHP Convention to the appellate court. The application requests that the convention be declared 'null and void'.
Former Hatay Metropolitan Municipality Mayor Lütfü Savaş and former CHP convention delegates have initiated the appellate process in the lawsuit filed to cancel the CHP's 38th Ordinary Convention.
The Ankara 42nd Civil Court of First Instance has shared with the public the reasoning behind its ruling of "no grounds for a decision", which it issued on the basis of the case "becoming moot" in the lawsuit filed for the cancellation of the 38th Ordinary Convention held by the CHP on November 4-5, 2023.
In the court's reasoned decision, it was recalled that the CHP Istanbul Extraordinary Provincial Congress was held on September 24 and the 22nd Extraordinary Convention of the CHP was held on September 21, under the supervision of the Supreme Election Council and by the Çankaya and Sarıyer District Election Boards, in accordance with the Law on Political Parties.
EMPHASIS ON LEGAL INTEREST
The reasoning stated that in these new congresses, provincial chairs, the party leader, and members of the party assembly and the high disciplinary board were re-elected, and the results were certified. Therefore, it was stated that the condition of "legal interest" regarding the old convention and congresses whose cancellation was requested had ceased to exist.
EXPULSION DETAIL
The decision also included information that some of the plaintiffs lacked the standing to sue, and that Lütfü Savaş and Yılmaz Özkanat had been expelled from the party at different times.
APPEAL APPLICATION
According to the report in Sözcü, following the publication of the reasoned decision, the plaintiffs moved the process to the next stage and took the decision to the Court of Appeal.

The plaintiffs' lawyer submitted the petition prepared for the appeal to the 42nd Civil Court of First Instance.
In the petition, while requesting the reinstatement of Kılıçdaroğlu, it was demanded that the convention be considered null and void from the date it was held, with the claim that it was "absolutely null and void."
