According to the report in Nefes, in the legal process that has been ongoing for 5 years, the high court ruled that TÜGVA was an unlawful occupier of the land and found that the Eyüpsultan District Governorship's failure to take action for the foundation's eviction was not in accordance with the law. The appeal filed by the district governorship against the decision was also definitively rejected by the appellate court.
It had been revealed that the headquarters of TÜGVA—whose High Advisory Board includes Bilal Erdoğan, the son of AKP Chairman and President Recep Tayyip Erdoğan—which was controversially built on IMM land in Eyüpsultan, had also been occupying the 1,000-square-meter IMM land right next to it since 2019 and using it as a parking lot.
When IMM personnel who went to the land to remove the occupation were not allowed to enter by TÜGVA, the IMM administration initiated a legal process. In the legal process initiated by the IMM in 2023, the court had ruled that TÜGVA was an occupier on the land.
In the decision, it was found that the rejection of the IMM's eviction application was unlawful, as the Eyüpsultan District Governorship should have taken action for the eviction of the foundation, which was in the position of an occupier.
