Crisis in the Narin Güran case: Defense attorneys file complaint against judge with HSK

A new development has occurred in the judicial process concerning the murder of Narin Güran, who was found dead in a creek bed 19 days after going missing in Diyarbakır. Attorneys for the 15 defendants, 6 of whom are in custody, being tried at the 17th Criminal Court of First Instance on charges of 'aiding and abetting a criminal,' have filed a complaint against the presiding judge with the Council of Judges and Prosecutors (HSK).

In the complaint petition submitted to the HSK by the defense attorneys, a series of allegations regarding procedural irregularities in the court process were listed. The attorneys claimed that the defendants were not reminded of their right to remain silent and other rights before their defense statements were taken during the hearing, and that the indictment was not read by the prosecutor. It was stated that this situation undermines the principle of a fair trial.

Another element highlighted in the complaint petition was the inclusion of a non-governmental organization with no direct connection to the incident as an 'intervening party' in the case. The attorneys deemed the inclusion of this association in the case as lacking legal basis.

CLAIM THAT DETENTION PERIOD LIMIT HAS BEEN EXCEEDED 

The petition, which recalled that the lower limit for the crime of 'aiding and abetting a criminal' under the Turkish Penal Code is 6 months, emphasized that the detention period for some defendants has exceeded 7 months. Therefore, it was stated that the defendants are being unjustly deprived of their liberty and that this creates liability.

For all these reasons, the defense attorneys have requested that the HSK initiate an investigation into the judge of the 17th Criminal Court of First Instance.
