Critical witness recounts the night of the incident in the Kubilay Kaan Kundakçı case: One-sentence defense from Alaattin Kadayıfçıoğlu
Witness Yalçınay Yıldız testified about the night of the incident in the trial regarding the murder of amateur footballer Kubilay Kaan Kundakçı in Ümraniye.
The second hearing of the trial regarding the murder of 21-year-old amateur footballer Kubilay Kaan Kundakçı in Ümraniye was held at the Anatolian 27th High Criminal Court. Seven defendants, including Aleyna Kalaycıoğlu and Alaattin Kadayıfçıoğlu, with 6 currently in custody, appeared before the judge again.
In addition to the statements of the defendants, the accounts of a critical witness regarding the night of the incident were also recorded during the hearing. Witness Yalçınay Yıldız described to the court the phone calls made between the parties before the incident and the subsequent armed attack.
It was reported that there was tension in the courthouse hallway before the hearing. According to a post by journalist Emrullah Erdinç, an argument broke out between Kubilay Kaan Kundakçı's father, Cemil Kundakçı, and witness Yalçınay Yıldız; the parties were calmed down by those around them.
Taking the floor in court, Kubilay Kaan Kundakçı's mother, Ülker Kundakçı, reacted to the defendants, stating that she did not believe the incident happened as described. Kundakçı said, "Everyone tells it differently. Shots are fired from outside, and no one says 'stop'."
WITNESS RECOUNTS THE NIGHT OF THE INCIDENT
Witness Yalçınay Yıldız stated that they were going to meet Aleyna Kalaycıoğlu at the studio and wanted Kubilay Kaan Kundakçı to take them there. Yıldız explained that during this time, a conversation took place regarding Aleyna Kalaycıoğlu having someone in her life, that Vahap Canbay was crying, and that Kubilay took the phone and said, "Sister, I want to reconcile you two."
Stating that they went to the studio but were not allowed inside, Yıldız noted that they later spoke with Aleyna Kalaycıoğlu by phone. According to Yıldız's statement, Kalaycıoğlu asked who was with him; Yıldız replied, "Kubilay is here."
Describing the moment of the incident, Yıldız said that a vehicle with flashing lights arrived after a while and stated, "At first, we thought a member of parliament had arrived. A person in a white t-shirt got out of the vehicle and hit the car window." Yıldız stated that he then saw a gun in this person's right hand.
"The person on the other side said, 'I won't see you again, get the hell out of here.' Then I heard a gunshot. Canbay was also shouting, 'Don't, don't'."
Upon questions from the presiding judge, Yıldız said that the same vehicle had passed by them before the incident. Regarding the question of which hand the gun was in, he replied, "It was in his right hand, he had grabbed Canbay by the collar with his left hand." Yıldız also stated that Canbay had raised his hand to protect themselves and was not holding the gun.
Speaking from the defendant's stand, Aleyna Kalaycıoğlu denied the allegation of incitement against her and requested her release. Kalaycıoğlu said, "There is no evidence that I incited this. Alaattin might be that ignorant, but I am not heartless. I have no strength left to endure. I am also a victim of this incident."
Alaattin Kadayıfçıoğlu, in his brief defense, stated, "I am very sorry. I have nothing else to say." The prosecutor of the hearing requested the continuation of the detention of the imprisoned defendants, citing the current state of evidence and the scope of the file.
