Defendant who cut his brother's throat and genitals gives strange response: "I wasn't in control"

In the incident that occurred on April 22, 2023, on the 4th floor of a 4-story building located on 204th Street in the 4th of July Neighborhood, it is alleged that Emre T. (30) stabbed his brother Murat Can T. (32) to death while he was sleeping and fled. 

Emre T., who had moved about 1 kilometer away from the house, caught the attention of police teams patrolling the area due to his suspicious behavior and the knife in his hand. Emre T., who confessed to the murder by telling the police officers who stopped him, "I killed my brother," was taken into custody.

It was determined that Murat Can T. had lost his life at the scene. It was revealed that Emre T. had cut his brother's throat and genitals.

"I GAVE MY DEFENSE AT THE PROSECUTOR'S OFFICE"

The trial of Emre T. began at the Kocaeli 1st High Criminal Court on charges of "killing a brother with monstrous feelings and by inflicting torture." The detained defendant Emre T., his lawyer, and his father N.T. attended the hearing. Given the floor for his defense, Emre T. said, "I will not make a defense. I gave my defense at the prosecutor's office. What I said at the prosecutor's office is only a tenth of what my brother did to me."

"IT DOESN'T MATTER AFTER THIS POINT"

Upon the presiding judge's remark, "If you don't explain, the situation will be to your disadvantage," the defendant said, "It doesn't matter to me after this point. I will not struggle to get a sentence reduction. Does a person harass their own brother? I always stayed silent. When I was little, he pulled my pants down in bed. Just as he was about to harass me from behind, my mother came to us because of my crying. She scolded us and put us back in the same bed. I haven't been able to tell this situation until now, I always stayed silent," he said.

"NO ONE KILLS THEIR BROTHER WITHOUT A REASON"

When asked if he was receiving psychological treatment, the defendant Emre T. said, "I am not receiving psychological treatment. The only thing that calmed me down was drugs. The sexual incident is one thing, but there were also times when my brother beat and threatened me. No one kills their brother without a reason.

The day before the incident, I told my father about the sexual incident I was subjected to.

I didn't go to the house where we stayed as a family that night. I had torn my shirt while telling my father about the events; when I went home in the morning to change, my brother said to me, 'What did you tell father, you scoundrel.' I don't remember what happened after that. The aftermath comes to my mind in pieces, but I don't want to remember it," he stated.

"THE KNIFE WAS IN MY HAND, I WASN'T IN CONTROL"

To the presiding judge's question, "Was there any meaning to cutting your brother's genitals?", the defendant replied, "I don't know, I wasn't in control. The knife was in my hand, but I wasn't in control."

FATHER DID NOT FILE A COMPLAINT

The father, N.T., who was heard regarding the incident, said, "Until the day of the incident, there was no hostility between my sons that would lead them to kill each other. I didn't see Murat beat Emre, but I saw them arguing. Since Emre didn't come home, I took him to a restaurant the night before the incident, and we drank alcohol together.

Emre told me, 'My brother attempted to sexually abuse me when I was 9 years old.' I said to him, 'You are 30 years old, why are you telling me now?' I wanted to confront Emre and Murat after leaving the restaurant, but Emre didn't come home. I left the house around 08:30 on the day of the incident.

After I left, Emre came home and the incident happened. No one was at home when the incident occurred. My wife was at her mother's, and my younger son was in the military. Emre did not receive any psychological treatment. Murat and Emre used drugs. I am not filing a complaint, I have nothing to say. The decision is yours. My wife passed away 39 days after the incident," he said.

"I DIDN'T HEAR ANY NOISE AT THE TIME OF THE INCIDENT"

The defendant's cousin, H.T., who was heard as a witness, said, "We reside in the same apartment building. I did not witness the defendant and the victim using drugs. I did not see Emre and Murat being disrespectful to our family.

I did not witness them arguing as brothers. I was in my own home at the time of the incident, I was sleeping.

After the incident happened, I went downstairs and saw that Murat had passed away. I didn't hear any noise at the time of the incident," he stated.

DEMAND FOR AGGRAVATED LIFE IMPRISONMENT

In his opinion, the public prosecutor requested that the defendant be sentenced to aggravated life imprisonment for the crime of "premeditated murder by inflicting torture with monstrous feelings" committed against his brother.

The court panel, upon the lawyer's request, decided to have the defendant referred to the Istanbul Specialized Department to obtain a report on whether he has criminal liability, to continue his detention, and adjourned the hearing to a later date.
