Defense of nurse who abused 5-day-old baby revealed in court! 'It was a momentary reflex'
In the trial of the nurse who made headlines for abusing a 5-day-old baby in Kahramanmaraş, the defendant testified in court, saying, "I am a mother too, I have a child in primary school who needs me. I am very regretful for the action I took."
The first hearing was held in the case opened regarding the allegation that a 5-day-old baby receiving treatment at the Neonatal Intensive Care Unit of a university hospital in Kahramanmaraş was abused. The nurse, H.D.B., who was arrested after the footage emerged, appeared before the judge today.
As part of the judicial process initiated regarding the blood-curdling incident that took place on May 26, 2021, at the Kahramanmaraş Sütçü İmam University Health Practice and Research Hospital Neonatal Intensive Care Unit, an arrest warrant had been issued for H.D.B.
The first hearing of the case was held at the Kahramanmaraş 10th Criminal Court of First Instance. The defendant nurse and the lawyers for the parties attended the hearing.
Upon being given the floor by the presiding judge, the defendant H.D.B., who connected to the hearing via SEGBİS, stated in her defense, "The behavior I exhibited happened with a momentary reflex. I did not do it with the intention of causing harm in any way. I was performing my profession in the best way possible. I am a mother, I have a child in primary school who needs me. I am very regretful for the action I took."
HER LAWYER REQUESTED RELEASE
The defendant's defense attorney Mustafa Çakrak, claiming that the baby was diagnosed with Down syndrome during the mother's pregnancy, said, "The mother has been admitted to intensive care multiple times. No causal link has been established regarding the incident; I request that my client be released."
The plaintiff's attorney Atty. Sait Bolat objected to this defense, stating, "Our client does not have such an illness. It is not possible for us to accept the mentioned report. We request the continuation of her detention."
It was stated that the Forensic Medicine Institute report included in the file was not accepted by either party. The court panel decided to continue the defendant's detention and to resolve the missing issues, while adjourning the hearing to April 1.
