A development that could change the course of the 'Ahmak Case' in which Ekrem İmamoğlu is being tried

In the case opened against Istanbul Metropolitan Municipality Mayor Ekrem İmamoğlu on the allegation that he called YSK members 'fools' (ahmak), the Istanbul 7th Criminal Court of First Instance sentenced İmamoğlu to 2 years, 7 months, and 15 days in prison, along with a 4-year political ban.

While all eyes are on the Court of Appeal regarding the case against İmamoğlu, an application has been made that could change the course of the trial.

Judge Halil Güner of the Çorum 3rd Criminal Court of First Instance has filed an application with the Constitutional Court (AYM) for the annulment of Article 125/3-a of the Turkish Penal Code (TCK). İmamoğlu's lawyer stated that if the article in question is annulled by the Constitutional Court, the case could be dropped.

According to the report in Cumhuriyet, Judge Halil Güner of the Çorum 3rd Criminal Court of First Instance utilized the views presented in a scientific opinion submitted by İmamoğlu's lawyers to the Istanbul Regional Court of Justice 24th Criminal Chamber on September 2.

APPLIED TO THE CONSTITUTIONAL COURT FOR ANNULMENT

Judge Güner filed an application with the Constitutional Court for the annulment of Article 125/3-a of the TCK, which is one of the articles under which İmamoğlu is being tried in the case, along with Article 125/5 of the TCK.

In the aforementioned opinion, it was argued that Articles 125/3-a and 5 of the TCK, which constitute the crime of "insulting a public official due to their duty," are unconstitutional, and it was requested that the file be sent to the Constitutional Court with a demand for the annulment of the provision.

'THE CASE COULD BE DROPPED'

Kemal Polat, the lawyer for Ekrem İmamoğlu, stated that following the objection filed by the Çorum 3rd Criminal Court of First Instance, there is a possibility that the "Ahmak Case" against İmamoğlu could be dropped if the article is annulled by the Constitutional Court.
