Expert report revealed: Passenger opening door cost motorcycle courier his life

In Istanbul's Şişli district, a taxi driver stopped at the end of a street to let his passenger out. As the female passenger opened the left rear door to exit, motorcycle courier Oğuzhan Gezer struck the door. Falling to the ground from the impact, Gezer hit the bumper of an oncoming minibus and was injured; despite a week of treatment in the hospital, he could not be saved. An expert report was prepared for the case file, which was examined by three engineers and a legal expert at the Council of Forensic Medicine. In Istanbul's Şişli Mecidiyeköy, on December 26, 2023, a taxi driver named İsa A. stopped near the street to drop off his customer. The female passenger sitting in the back seat opened the door to exit the taxi after paying her fare.

At that moment, motorcycle courier Oğuzhan Gezer, who was attempting to pass on the left side of the taxi, struck the opening door. Oğuzhan Gezer, who fell to the ground due to the impact, was also lightly struck by a minibus coming from the opposite direction.

Upon notification, police and medical teams were dispatched to the scene. After receiving initial treatment at the scene, motorcycle courier Oğuzhan Gezer was taken to the hospital.

LOST HIS LIFE IN THE HOSPITAL

Police teams took a statement from Gezer while he was undergoing treatment at the hospital. In his statement, Gezer filed a complaint against the taxi driver İsa A. and the female passenger. Taxi driver İsa A. was referred for arrest following his statement at the prosecutor's office.

The judge decided to release the suspect under judicial control. As part of the investigation conducted by the Istanbul Chief Public Prosecutor's Office, the file was sent to the Council of Forensic Medicine for an examination of the footage regarding the moment of the accident.

TAXI DRIVER FOUND FAULTLESS, PASSENGER DEEMED AT FAULT

According to the report by Atakan Irmak from Sabah; an expert report was prepared for the file, which was examined by three engineers and a legal expert at the Council of Forensic Medicine.

The report determined that taxi driver İsa A. was faultless during the accident, and the late courier Oğuzhan Gezer was found to have minor contributory negligence.

According to the report, the accident was caused by the tourist who was a passenger in the taxi opening the door, and therefore, the passenger was stated to be the primary party at fault.

The investigation conducted by the prosecutor's office regarding the incident is ongoing.
