The first hearing for the accident caused by Fatma Zehra Kınık Demir, daughter of former Turkish Red Crescent (Kızılay) President Kerem Kınık, which resulted in the death of 17-year-old Batın Barlasçeki and left two others injured on July 9, was held on October 30 at the Istanbul Anatolian 8th High Criminal Court.

In the hearing, which was closed to the press and the public, Fatma Zehra Kınık Demir submitted her defense in writing to the court. The written defense of Demir, whose judicial control measures were also lifted, has been revealed.

'I HAVE NO FAULT'

According to the report by İsmail Arı from BirGün; Fatma Zehra Kınık Demir's written defense is as follows:

“I do not accept the accusations in the indictment. I have no fault or negligence in this incident... While I was driving, a motorcycle suddenly came at high speed and hit my front left headlight. I immediately stopped my vehicle and tried to understand what happened. Afterwards, I started crying due to the shock I experienced. I saw the person behind the motorcycle lying on the ground injured. I asked for help from those there, saying, ‘Please call an ambulance, someone call an ambulance.’ Someone said the injured person was breathing. I never left their side until the injured were taken away by ambulance. When I arrived at the scene of the accident, I learned that the motorcycle had skidded and hit two citizens on the sidewalk.”

'I DEFINITELY HAVE NO FAULT'

I have no fault whatsoever in the occurrence of this accident. I set out in full compliance with traffic rules, and my speed was in accordance with traffic regulations. After checking my right and left, I entered the road after the minibus driver gave way and allowed me to pass. I acted in accordance with all requirements. However, unfortunately, the motorcycle was traveling very fast. The street where the incident occurred is a very busy street, and vehicles pass through constantly. There is a bus stop to the left of where I entered the road. There are also signs on the road indicating that the speed limit is 30 kilometers and that it is a pedestrian path. This sad event occurred because they were using the motorcycle in violation of traffic rules and without helmets or protective equipment. I definitely have no fault in this incident.

'I SIGNED IN 5 DAYS A WEEK'

After the incident, we continued to be by the side of the deceased and the injured. We met with motorcycle driver Yavuz Selim Öztürk and his family at the Beykoz Courthouse. We conveyed our deep sadness regarding the incident and our well wishes to them. The very day after I was released from custody, I visited the home of the late Batın Barlasçeki's family with my family to convey our condolences. We were all very sad. I sat next to the deceased's mother, Hasret, we hugged, read prayers, and said we would always be by their side. During this time, we also tried to reach the two people injured in the accident. We could not reach Muammer Kızıl, whose name we learned later, at the hospital because his injury was treated on an outpatient basis and he was discharged the same day. We learned that the other injured person, İbrahim Ethem Üstünışık, was at Ümraniye State Hospital; we went to visit him and offered our well wishes. He thanked us for our visit, stating that this was an accident and that he would not file a complaint.

After this sad accident, unfortunately, both I and my family were subjected to very ugly slanders. Untrue news was published about us. It was said that I fled abroad. However, since the accident happened, I have continued to sign in at the Kavacık Police Station 5 days a week.

'IT WAS MY FIRST ACCIDENT'

I have held a driver's license since I was 19 and have been driving for 7 years. On July 9, I experienced a traffic accident for the first time. I truly experienced great shock and sadness. The passing of Batın Barlasçeki deeply saddened me as well. Everything I went through was a great psychological breakdown for me. In addition to all this, while waiting for the first hearing day, I was subjected to very ugly slanders and death threats on social media. Many people claiming to be journalists persistently tried to reach me and my family by calling or messaging us. Unknown numbers sent threatening messages about me to my family's phones.

'I REQUEST MY ACQUITTAL'

It is truly painful that this accident happened. I once again offer my condolences to the family of the deceased, I share their pain, and I wish a speedy recovery to the injured. I absolutely do not accept the traffic accident report stating that I am at fault. I respectfully submit and request from your honorable court that a verdict of acquittal be rendered for me.”

WHAT HAPPENED?

In the accident that occurred on July 9 on Fatih Sultan Mehmet Street in Kavacık Neighborhood of Istanbul's Beykoz district, Fatma Zehra Kınık hit a motorcycle while exiting Baki Street onto Fatih Sultan Mehmet Street.

In the accident, the driver of the motorcycle, Yavuz Selim Öztürk, and the person behind him, Batın Barlasçeki, fell off the motorcycle, and the riderless motorcycle hit pedestrians, causing injuries. While the driver Öztürk survived the accident with injuries, Barlasçeki, who hit his head on a concrete bollard on the sidewalk, lost his life. The car driver, Fatma Zehra Kınık, who was taken into custody, was released by the court to be tried without arrest.

Recently, an indictment was prepared by the Anatolian Chief Public Prosecutor's Office against Fatma Zehra Kınık for the incident that caused the death of 1 person and the injury of 4 people, on charges of "causing death and injury by negligence."

In the indictment, it was requested that Fatma Zehra Kınık be sentenced to imprisonment from 2 years to 15 years for the crime of "causing death and injury by negligence."

EXPERT: '100 PERCENT AT FAULT'

An expert report had been prepared regarding Fatıma Zehra Kınık Demir, daughter of former Kızılay President Kerem Kınık.

In the report, it was stated that Fatıma Zehra Kınık Demir was 100% at fault. In the report prepared by retired police officer İbrahim Bayşu, who served as an expert in the Istanbul Judicial Commission upon the request of the lawyer of the late Batın Barlasçeki, Uysal Uğurlu, the following was listed:

“In the occurrence of this accident, Fatıma Zehra Kınık Demir, with the vehicle under her direction and control, entered the main road without obeying the “STOP” sign at the end of Batın Street in Beykoz district of Istanbul province, without waiting for the passage of vehicles coming from the main road, Fatih Sultan Mehmet Street, and as a result of hitting the vehicle passing in front of her, she committed the primary fault H (not complying with the right of way at intersections) included in Article 84 of the Highway Traffic Law No. 2918, and the fault (not complying with traffic signs and signals) included in Article 47 of the same law, and therefore, as she is primarily at fault, she is 100% at fault...”
