Former Red Crescent President Kerem Kınık's daughter found primarily at fault in accident

The report from the Forensic Medicine Institute's Traffic Specialization Department has been added to the court file in the trial of Fatma Zehra Kınık Demir, daughter of former Red Crescent President Kerem Kınık, who faces up to 15 years in prison for causing death and injury by negligence.

According to a report by İsmail Arı from Birgün, the document submitted to the Istanbul Anatolian 8th High Criminal Court states that Fatma Zehra Kınık Demir is primarily at fault.

The report included the following statements:

"Defendant driver Fatma Zehra Kınık Demir, while operating her vehicle, was required to observe the 'Stop' traffic sign at the intersection, come to a halt, and sufficiently check the flow of traffic on the one-way, two-lane road before proceeding. She was also required to yield the right of way to the motorcycle driven by the complainant, which was approaching from the left side of the intersection and intending to continue straight. By failing to comply with these requirements and subsequently colliding with the motorcycle, she acted in violation of her duties of care and attention, and is therefore primarily at fault."

The report prepared by the Forensic Medicine Institute's Traffic Specialization Department emphasized that Yavuz Selim Öztürk was partially at fault, while the deceased, Batın Barlasçeki, held a minor degree of partial fault.

WHAT HAPPENED?

In the accident that occurred on July 9, 2024, on Fatih Sultan Mehmet Street in the Kavacık neighborhood of Istanbul's Beykoz district, Fatma Zehra Kınık collided with a motorcycle while exiting Baki Street onto Fatih Sultan Mehmet Street.

During the accident, the motorcycle's driver, Yavuz Selim Öztürk, and his passenger, Batın Barlasçeki, fell from the bike, while the riderless motorcycle struck pedestrians, causing injuries. While the driver, Öztürk, survived the crash with injuries, Barlasçeki lost his life after hitting his head on a concrete bollard on the sidewalk. The car driver, Fatma Zehra Kınık, was taken into custody but was released by the court to be tried without arrest.

Recently, an indictment was prepared by the Anatolian Chief Public Prosecutor's Office against Fatma Zehra Kınık for the charges of "causing death and injury by negligence" in relation to the incident that resulted in the death of one person and the injury of two others.

In the indictment, it was requested that Fatma Zehra Kınık be sentenced to between 2 and 15 years in prison for the crime of "causing death and injury by negligence." The report stated: "The defendant driver, Fatma Zehra Kınık Demir, is primarily at fault for failing to comply with her duty of care and attention in the incident. She should have stopped at the intersection, taking into account the 'Stop' traffic sign, and sufficiently checked the flow of traffic on the one-way, two-lane road before proceeding. She failed to yield the right of way to the motorcycle driven by the complainant, which was coming from the left side of the intersection and intended to continue straight, resulting in a collision."

The report prepared by the Forensic Medicine Institute's Traffic Specialization Department emphasized that Yavuz Selim Öztürk was secondary at fault, while the deceased, Batın Barlasçeki, was found to have a low level of secondary fault.
