He abused and killed a 6-year-old child: Details of the investigation into the Şirin Elmas murder have been revealed
A lawsuit has been filed against the paper collector who sexually abused and killed 6-year-old Şirin Elmas Hanilçi. The sentence requested for the defendant, Mustafa Örün, has also been announced.
A lawsuit has been filed against Mustafa Örün, a waste collector arrested for the murder of 6-year-old Şirin Elmas Hanilçi at the Feriköy Cemetery in Şişli, Istanbul, on October 31, on charges of "intentional murder of a child," "deprivation of liberty of a child for sexual purposes," and "sexual abuse of a child."
The indictment prepared by the Istanbul Chief Public Prosecutor's Office stated that Şirin Elmas Hanilçi had gone to her grandmother's house on October 31 with her mother, Yeter Hanilçi, and her siblings.
The indictment noted that on the same day, around 15:30, the little girl's mother, grandmother, and grandfather went out to pay a bill, taking the children with them, and that mother Hanilçi did not take Şirin with them, saying, "You don't come, play with your aunt's daughter, I will be back."
The indictment stated that after the adults left, Şirin went outside with her two siblings, and while her siblings returned home after a while, she did not.
The indictment mentioned that Hiranur Hanilçi, one of the siblings who went out with the little girl, stated in her testimony that Şirin, who was playing with toys in front of the house, disappeared after a while, and that security camera footage related to the incident was examined.
According to the camera recordings, it was explained that on the day of the incident, around 16:35, Şirin entered Ülker Street alone from Avukat Street, and from there into Poyraz 1 Street, where the defendant Mustafa Örün approached Şirin with his scrap collection vehicle and began to communicate and establish closeness with her.
The indictment recorded that defendant Örün talked to Şirin along the way, stopped by trash containers to collect paper, and around 16:45, arrived at the intersection of Poyraz 1 Street and Hasret Street with Şirin, proceeding from there toward the Feriköy Cemetery.
HE PREVENTED HER FROM MAKING A SOUND WITH A SCARF
The indictment stated that the defendant took Şirin between two graves in a secluded area near the entrance gate of the Feriköy Cemetery, where he first stuffed a scarf into her mouth to prevent her from making a sound before committing sexual abuse, and that the child struggled to escape from the defendant but failed.
The indictment determined that after committing the abuse, defendant Mustafa Örün decided to kill Şirin to eliminate evidence, conceal the crime, and avoid being caught, and that he removed the scarf he had stuffed in her mouth, wrapped it around her neck, and killed the little girl in this manner.
The indictment stated that after making sure she was dead, the defendant dressed Şirin, laid her between two graves, and covered her with grass, adding, "Considering the way the incident occurred, it is understood that the defendant acted with sexual motives from the first moment he encountered the victim child, manipulated her in some way to keep her with him, decided to take her to the cemetery, which is not a frequented place, and tried not to attract attention by continuing to collect paper while walking with the victim."
FORENSIC MEDICINE: KILLED BY STRANGULATION
The indictment, which stated that according to the Forensic Medicine Institute Morgue Specialization Department report, traumatic findings were detected on Şirin's body and external genital organs, and that her death occurred due to lack of oxygen caused by strangulation, also included the testimony of the defendant, who was arrested after the incident.
In his testimony, defendant Örün claimed that the little girl he encountered while collecting paper in Feriköy asked for 100 liras, and that he told her he had no money with him, saying, "Afterwards, I continued walking. This girl started following me. During the walk, she asked me for money two more times. We walked together to the Feriköy Cemetery. As I kept saying I had no money, the child replied, 'You have money.' When I entered through the cemetery's outer gate, the girl entered with me."
DEFENDANT CONFESSED TO THE CRIME
The indictment noted that defendant Örün claimed in his testimony that he refused the child's repeated requests for money while in the cemetery, and that he got angry when the child insulted him; he confessed to taking the scarf the child was wearing, stuffing it into her mouth to commit sexual abuse, and then wrapping the scarf around her throat to strangle the child.
The indictment stated that in his testimony, the defendant said he dressed the child after making sure she was not breathing, laid her between two graves, and covered her with grass, adding, "I decided to kill the child because I was worried she would tell her family that I had sexually assaulted her."
Stating that he showed the police teams where the girl was after being taken into custody, the defendant said in his testimony that he accepted the accusations against him.
The indictment requested that defendant Örün be sentenced to aggravated life imprisonment and 6 to 21 years in prison for "intentional murder of a child or a person who cannot defend themselves physically or mentally, for the purpose of concealing a crime, eliminating evidence, facilitating its commission, or avoiding capture" and "deprivation of liberty of a child or a person who cannot defend themselves physically or mentally for sexual purposes," and to a prison sentence of no less than 18 years for the crime of "sexual abuse of a child."
The indictment, approved by the Chief Public Prosecutor's Office, was accepted by the Istanbul High Criminal Court. The defendant's trial will begin on January 9.
