The petition stated that defendant Nevzat Bahtiyar's communication with defendant Salim Güran just before the crime took place on the day of the incident, and his presence at the scene with the other defendants according to narrow-area base station records, reveals that the defendant was in the position of a "joint perpetrator."

Furthermore, the petition highlighted that after the crime was committed, defendant Bahtiyar transported Narin Güran's lifeless body in his own vehicle, hid the corpse in the Eğertutmaz stream, and failed to report the incident to the authorities for the subsequent 17-day period, which demonstrates that the defendant acted in unity of intent and action with the other defendants. "It is erroneous to decide to sentence defendant Nevzat Bahtiyar under Article 281/1 of the Turkish Penal Code on the grounds that he committed the crime of 'destroying, concealing, or altering evidence of a crime,' when he should have been sentenced for the crime of 'intentional killing of a child' in complicity, which falls under Article 82/1-e of the Turkish Penal Code. We request that the verdict be overturned through appellate review and that the defendant be sentenced for the act charged against him in the indictment."
