Radical changes coming to alimony! That practice is being abolished

The Ministry of Justice is preparing a comprehensive reform in the field of family law. According to the new regulation, divorce cases will be conducted more quickly and effectively.

In this context, issues of property division, alimony, compensation, and custody will each be handled as separate cases. This aims to prevent grievances arising from long-drawn-out divorce processes.

DIVORCE DURATION WILL BE SHORTENED

According to a report by Yeşim Eraslan from Türkiye Gazetesi, international examples were examined in the study prepared by the Ministry of Justice. Similar to practices in Europe, specific cases will be opened for each issue to prevent the divorce process from being unnecessarily prolonged.

In this way, it is aimed that the parties suffer less psychological and economic harm. Additionally, a mediation mechanism will be activated for non-violent disputes.

INDEFINITE ALIMONY IS BEING ABOLISHED, EXCEPTIONS ARE PROTECTED

The issue of lifetime alimony is also changing significantly with the new regulation. Controversial practices, such as paying alimony for years after a one-day marriage, will be ended.

When determining the alimony period, factors such as the duration of the marriage, the economic status of the parties, and the degree of fault will be taken into account. However, the indefinite alimony practice will continue for women who are unable to work.

A FAIRER SYSTEM IS TARGETED

With the new regulation, it is planned to bring a fairer and more sustainable system to divorce cases.

In particular, by handling property division and alimony cases separately, it is aimed to prevent the parties from experiencing grievances. The Ministry of Justice is expected to bring this reform to the agenda of the Grand National Assembly of Turkey (TBMM) in the near future.
