In the case of 8-year-old Narin Güran, who was the victim of a brutal murder in Tavşantepe Village in the Bağlar district of Diyarbakır, her mother Yüksel, brother Enes, and uncle Salim Güran, who were tried at the Diyarbakır 8th High Criminal Court, were sentenced to aggravated life imprisonment for the crime of 'participating in the murder of a child'.

Nevzat Bahtiyar, who took the little girl's lifeless body from her uncle and buried it in the Eğertutmaz Stream, 1.5 kilometers away from the village, was sentenced to 4 years and 6 months in prison for the crime of 'concealing and destroying evidence'.

Brother Enes Güran's lawyer, Mustafa Demir, appealed the conviction decision rendered against his client and filed an application with the Diyarbakır 8th High Criminal Court. The petition was submitted to be forwarded to the 1st Criminal Chamber of the Diyarbakır Regional Court of Justice.

Pointing out that the Narin Güran incident is an unprecedented case, Demir stated, "We believe that all segments of society will agree that this file is an incident that has resonated throughout Turkey and even the world.

In an incident that has had such a profound impact on public opinion, we would have wished for the procedures carried out by law enforcement, the prosecutor's office, and the court to be conducted with the necessary care and sensitivity in the face of all statements, reports, requests, and news coverage. However, we have sadly experienced that this was not the case."

In his petition, lawyer Demir drew attention to the fact that the defendant Nevzat had given money to Narin before the incident, specifically to gain her trust, saying, "Given that he magnified the problem arising from the vehicle dispute he had with Narin's father in his inner world and, through his behavior reflected to the outside world, told his own relatives to stay away from this family, and considering that Nevzat was also completing the construction of a house he was preparing to move into in another village, there is no evidence that he did not act with the intention of harming Arif's family. We are of the opinion that the court's acceptance that the defendant Nevzat had no motive to kill Narin is far from the file, and that this issue should be re-evaluated with the incident duration and the cell tower data (PSA)."

"CONTRADICTORY POINTS WERE IGNORED"

Lawyer Mustafa Demir included the following statements in his petition, where he also referenced the cell tower and UKB (National Crime Bureau) reports:

"A matter of importance here is that the statements of the defendant Nevzat Bahtiyar, the findings of the UKB, and the Narrowed Cell Tower Study were taken as the basis for the decision, but it was ignored that these 3 subjects do not support each other in terms of content and that there are points where they contradict each other. Due to the conviction decision being contrary to the law in terms of procedure and substance, we request the reversal of the verdict and the acquittal of my client. Considering that there is no concrete evidence that my client participated in the alleged crime, that the conviction decision rendered by the court of first instance with irrelevant and insufficient grounds is unlawful, and that the defendant's continued detention is based on grounds completely devoid of legal basis, and that the unjustly continuing detention causes irreparable harm to both the defendant client and his family, we request that my client's detention status be evaluated as a priority and that his release be decided."
