Gökçek to be evicted from home where irregularities were found in sale! He lost the lawsuit

Former Ankara Metropolitan Municipality Mayor Melih Gökçek will be evicted from the duplex residences he purchased from the Ankara Metropolitan Municipality in 2018 in the names of his wife and his lawyers, and which he still uses, after a lawsuit filed by Mansur Yavaş determined that the sale was irregular and the properties were transferred back to the Ankara Metropolitan Municipality (ABB).

The lawsuit filed by Mansur Yavaş against Melih Gökçek's unlawful purchase of the residences in Dikmen—which were previously municipal housing—in the names of his wife, Nevin Gökçek, and his lawyers, Fatih Atalay and Salih Çelen, has concluded.

TO BE EVICTED

The Ankara Regional Court of Justice ruled that the purchase was irregular and ordered the registration of the properties, which Gökçek still uses as a residence and office, in the name of the Ankara Metropolitan Municipality. Gökçek will be evicted from the home he has been occupying unlawfully.

WHAT HAPPENED?

While serving as the Mayor of the Ankara Metropolitan Municipality in 2017, Gökçek prepared the tender for the sale of the residences he was using as municipal housing. Although the law explicitly states that a Mayor and their relatives cannot participate in a tender within three years of leaving office, the tender was won by a business partnership consisting of Gökçek's wife, Nevin Gökçek, and his lawyers, Fatih Atalay and Salih Çelen.

Gökçek continued to reside in the duplex home, which he was required to vacate within two months of leaving office. The sale was carried out while Gökçek was still living in the residences.

The Legal Consultancy of the Ankara Metropolitan Municipality, under the administration of Mansur Yavaş, filed a lawsuit alleging that the sale of the public properties was irregular. The lawsuit emphasized that, in addition to the irregularities in the tendering process, the valuation commission's report failed to account for a swimming pool that Gökçek had built in violation of the project plans, which would have affected the tender price.

The appeal filed by the ABB administration against the local court's decision was accepted. The Ankara Regional Court of Justice ruled that the purchase was irregular and ordered the registration of the properties, which Gökçek still uses as a residence and office, in the name of the Ankara Metropolitan Municipality.

The four duplex residences, which were sold for 7 million 900 thousand TL in 2018, have returned to the Ankara Metropolitan Municipality. Gökçek will be evicted from the home in Dikmen where he has been residing unlawfully.

The Prosecutor's Office had previously issued a decision of non-prosecution regarding a criminal complaint filed by the Ankara Metropolitan Municipality on the same matter. Following the court's decision, the ABB will apply to the Prosecutor's Office to have the file reopened.
