He accessed UYAP with prosecutors' passwords and closed "FETÖ" files: 27-year prison sentence and conditional release

The Ankara Chief Public Prosecutor's Office launched an investigation following a tip-off from Zeliha E., the ex-wife of Yılmaz, who worked as a court clerk at the Ankara Courthouse. The tip-off alleged that Yılmaz had removed precautionary measures and issued non-prosecution decisions in exchange for money in files directed by "FETÖ" fugitive lawyer Muhammet Talha Bol.

At the end of the investigation, an indictment was prepared against 16 suspects, including court clerk Yılmaz. The indictment stated that Yılmaz used the UYAP passwords of the assigned prosecutors to issue 'lack of jurisdiction' warrants, changed the UYAP workflow without a prosecutor's authorization, issued decisions for non-prosecution, consolidation, separation, and the lifting of arrest warrants, and created forged documents to obtain financial gain. Ahmet Yılmaz faced a total of up to 1,190 years and 5 months in prison for the charges of 'Aiding an armed terrorist organization', 'Unauthorized access to an information system', 'Violation of confidentiality', 'Chain-offense forgery of official documents', 'Destruction of evidence', 'Aiding and abetting a criminal', and 'Bribery'.

It was stated that Yılmaz's ex-wife, Zeliha E., committed the crime of 'Acting as an intermediary for bribery', but it was requested that she not be sentenced under the scope of effective remorse. The other 15 suspects were requested to be punished for the crimes of 'Bribery', 'Membership in an armed terrorist organization', 'Violation of confidentiality', 'Incitement to forgery of official documents', and 'Aiding and abetting a criminal'.

He requested acquittal

The hearing held at the Ankara 28th High Criminal Court was attended by the detained defendant Yılmaz, some defendants who were tried without detention, and the lawyers of the parties. The presiding judge stated that the defenses against the opinion on the merits had been received in the previous session and asked the detained and non-detained defendants for their final statements. Defendant Yılmaz stated that his mental health had deteriorated due to what he had been through, saying, "I divorced my wife. My daughter got married, I don't even know about it. These things have started to weigh heavily on me. I have started taking schizophrenia medication. I request my acquittal and release." The other defendants also claimed they were innocent and requested acquittal from the court.

Travel ban imposed

Announcing the verdict after the statements, the court sentenced the detained defendant Yılmaz to a total of 27 years and 2 months in prison for the crimes of 'Membership in an armed terrorist organization', 'Bribery', 'Forgery of official documents', 'Destruction, concealment, or alteration of evidence', 'Aiding and abetting a criminal', and 'Unauthorized access to an information system'. While the court acquitted the defendant Yılmaz of the charge of 'Violation of confidentiality', it ruled for his release with the application of a judicial control measure in the form of a travel ban.

Among the defendants tried without detention, Reşat Yıldırım was sentenced to a total of 18 years and 1 month in prison for the crimes of 'Membership in an armed terrorist organization', 'Bribery', 'Forgery of official documents', 'Destruction, concealment, or alteration of evidence', and 'Aiding and abetting a criminal'. Yıldırım was also acquitted of the charge of 'Violation of confidentiality'. Non-detained defendant Ömer Faruk Bol was sentenced to 12 years and 11 months in prison on charges of 'Membership in an armed terrorist organization' and 'Bribery'. Defendant Yusuf Ersin Gürbüz received a 3-year and 4-month prison sentence for 'Bribery'. The file of 1 defendant was separated.

10 defendants were acquitted

The other non-detained defendants Atilla K., Ayhan G., Emrullah D., Halil Ziya Z., Muhammet Kamil G., Murat A., Mustafa Ş., Zeliha E.U., Şaduman G., and Tuğba G. were acquitted of the charges.
