He caused his son's death: Messages he sent to his family revealed

The incident occurred on November 14, 2022, at an apartment on Kuvayı Milliye Street in the Ayazma neighborhood.

A dispute broke out between Yunus Ş. (24), who was allegedly a drug addict, and his father, Şakir Ş. (55).

When the argument escalated, Yunus Ş. attacked his father. Retaliating, the father, Şakir Ş., choked his son. Upon seeing that his son had lost consciousness, Şakir Ş. released his throat. The mother, Arzu Ş., notified the 112 Emergency Call Center.

Despite all interventions at the hospital, the health worker Yunus Ş. could not be saved and lost his life. Şakir Ş., who was taken into custody, was arrested by the court and sent to prison.

In the first hearing held on November 1, 2023, the defendant was released under judicial control to be tried without arrest.

"I HAVE BEEN SLEEPING ON THE STREET FOR DAYS"

The hearing of the case opened regarding the incident continued at the Kocaeli 3rd High Criminal Court.

The defendant, Şakir Ş., who is being tried without arrest, and his lawyer, Hakan Akkaya, attended the hearing. It was reported at the hearing that Yunus Ş.'s mobile phone had been examined and contained several messages directed at his family. It was learned that one day before the incident, Yunus Ş. had sent a message to his father saying, "Why don't you wait for me and just leave? I have been sleeping on the street for days."

"I WILL FILE A COMPLAINT AGAINST ALL OF YOU"

It was revealed that he had sent a message to his mother stating, "I am not using drugs, you don't understand what I'm saying. You are misrepresenting me to people. Ibo (his older brother) is pinning me to the ground. I am struggling, I can't breathe, and you ask 'Why are you struggling?' Of course I will curse, he is pressing on my chest. I will file a complaint against all of you for slander. I got a medical report for battery. I will file a criminal complaint. I came home to sleep comfortably, you are having the police take me away. See you at the courthouse on Monday. Stop calling me a drug addict. Did you hear me everywhere?"

THE FATHER WAS ASKED ABOUT THE MEANING OF THE MESSAGES

The presiding judge asked the defendant father, Şakir Ş., what the message "Ibo is pinning me to the ground. I am struggling, I can't breathe, and you ask 'Why are you struggling?' Of course I will curse, he is pressing on my chest" referred to. Upon this, Şakir Ş. said, "Our conversations with my son on the morning of November 13, 2023, date back to one day before the incident, as I explained before. We had picked Yunus up from the terminal. Afterwards, after going to the police station and back, Yunus tried to run away when he saw us. During this time, I ran and caught him. My son İbrahim was also with me. There was a scuffle between us to restrain Yunus. That is why the conversations seen in the phone examination took place between us."
"I request an investigation into the report that the victim held a knife to his mother's throat"
Defendant's lawyer Hakan Akkaya said, "I want an investigation to be conducted regarding the incident mentioned in the previous statements of the defendant and witnesses where the victim held a knife to his mother's throat. The victim's brother made a report to the 112 Emergency Call Center regarding this matter. I request that the report and the audio recording, if any, be retrieved."

The court board decided to accept the lawyer's request and adjourned the hearing.

DEFENSE IN THE FIRST HEARING

On the other hand, in his defense at the first hearing held on November 1, 2023, Şakir Ş. had stated that Yunus lived in Istanbul, came to Kocaeli from time to time, and had come to Kocaeli by bus from Istanbul one day before the incident, and that they had gone to the bus terminal with family members to pick him up.

Şakir Ş. stated that they had gone to the bus terminal with the police because Yunus was constantly threatening his mother, that Yunus cursed when he saw the police, and that they went to the police station to give statements together, adding, "After a while, they released Yunus from the police station too. A father's heart, I couldn't bear it. When I went to the police station area, I saw Yunus sleeping in the park. He ran away when he saw me, I caught him by running. My intention was to bring him home, my heart could not accept him sleeping on the street. My older son İbrahim and my wife Arzu were also with me. We got into the car to go home together. I stopped on the way to buy water. While I was going to buy water, Yunus shouted to the guards, 'They are going to kill me.' The guards took us to the police station. I told them my son was ill and asked them to give him to us, but they did not accept, saying he was 24 years old. Upon this, we went home."
