He wrote a letter from prison: 'Tosuncuk' promises payment on condition of house arrest

The 45,376-year and 6-month prison sentences handed down to Mehmet Aydın, nicknamed 'Tosuncuk', and his brother Fatih Aydın, who were accused of defrauding thousands of people through the Çiftlik Bank system they established, had been finalized.

Mehmet Aydın, known as 'Tosuncuk', sent a letter from prison through his lawyer, Sevinç Eraslan. According to the report by Dilek Yaman Demir from Ekol TV, the letter states that in response to the fraud charges, Aydın claims he could compensate the losses of Çiftlik Bank victims if he were released to house arrest.

HE CLAIMED HE WOULD MAKE PAYMENTS IF RELEASED TO HOUSE ARREST

Mehmet Aydın, who is being tried on fraud charges, expressed that he could make payments to the victims if he were placed under house arrest with the following statements:

“Bitcoin production continues in my facilities; release me so I can pay the victims.”

Mehmet Aydın's letter used the following expressions:

"I am Mehmet Aydın, and I have been a convict at the Edirne F-Type Closed Penal Institution for 4.5 years.

Regarding the case that all of Turkey is aware of, the only thing that has not changed since the beginning of the process is my focus on compensating the victims' losses and my expression of intent to pay at every stage of the local court proceedings.

According to the expert report, 4,414 people have a total claim of 70 million 514 TL.

According to the same report, my seized cash and assets are many times greater than the determined loss.

Moreover, in the past 8 years, this figure has reached 2 million TL. My 3 companies under trusteeship have a paid-in capital of 156 million TL. In this case, my companies' assets have been in a position to cover the victims' losses from the very beginning.

If the trustees appointed to the company had sold the assets by remaining loyal to the contract and compensated the victims' losses, there would not be a single victim left. It is clear that I had no intention to defraud from the very beginning. I have been imprisoned for exactly 1,643 days. I surrendered by taking refuge in my innocence while I was already in a country where I lived freely outside of Turkey.

The biggest reason for my voluntary surrender was to prevent the victimization issue from leading to irreparable damages. In every hearing I attended during the local court phase, I stated that my intention to pay was extremely sincere and real, provided that I was given the opportunity to compensate for the losses and released under judicial control conditions.

Despite the effort I have maintained in every way, I am still in prison as the only person who can resolve the victimization issue due to the shortness of the 3-month period given to me, the state's seizure of all the company's assets, and the detention during the process.

It is obvious that as long as I am in prison, the issue of compensating for the loss becomes impossible. The fact that the other defendants tried for the same crime as me are either being tried without arrest or are currently fugitives, that they received the same sentence, and that I am the only one who has shown authorized and voluntary effort to compensate for the loss, has never been brought to the agenda as an important issue. This letter, which I want to share with the intention of calling out to the victims before all procedures regarding the file, which is on the way to the Court of Appeal, are completed, is the greatest proof that I intend to bring some relief to the hearts of all victims.

I want to resolve this issue if the victims reach me with the specified proposals within the scope of the reconciliation law that will go to the Parliament. On 24/01/2011, I established Turkey's largest Bitcoin production facility. The Bitcoin machines located in the Bitcoin facility, which is currently operating in Uruguay and Paraguay, are actively continuing production. I reiterate once again that I have the ability to compensate for the losses if I am given the opportunity within the scope of the house arrest application as a condition of judicial control, and I announce this to all victims and the public."
