The application method for how PKK terrorists will benefit from the framework law proposal, which was accepted by Parliament on August 10, has begun to become clear.

The regulation is expected to enter into force after being published in the Official Gazette, following confirmation by the MİT and the National Security Council that the terrorist organization PKK, along with all its extensions and components, has laid down its arms and been liquidated.

Within the scope of the law, which is stated to be applied for a period of six months, PKK members who will surrender will apply to judicial authorities with standard, or uniform, petitions. According to information obtained from judicial circles, these petitions will not include a declaration of remorse similar to the "effective remorse" provisions regulated in Article 221/2 of the Turkish Penal Code.

In the petitions to be prepared, it will be requested that the applicant's legal status be evaluated within the scope of the new regulation and that their file be finalized according to the current state of evidence.

According to the report in Nefes, the petitions will include the following statement: "In accordance with the relevant article of the Law on Strengthening National Solidarity and Social Integration, I request that my legal status be handled accordingly, that the necessary examinations and procedures be carried out to benefit from the law based on the current state of evidence, and that my file be finalized."

It is stated that the petitions will be in the nature of a standard document; they will only contain personal information such as the name, surname, mother's and father's name, place and year of birth, and T.C. identity number of the surrendering PKK terrorist.

It is noted that the new practice will be different from the "effective remorse" process that was implemented for the 30 PKK terrorists who came from Qandil and Mahmur and surrendered to security forces at the Habur Border Gate during the 2009 opening process. For this reason, a condition of remorse will not be sought in the application texts.
