Hüseyin Ersöz reacts to the ruling in the Pınar Gültekin case: 'I find it difficult to comprehend'

In the case of university student Pınar Gültekin, who was brutally murdered by Cemal Metin Avcı in Muğla in 2020, the Court of Cassation has issued a scandalous ruling. The aggravated life sentence for murder suspect Cemal Metin Avcı was overturned on the grounds that "burning someone alive does not constitute a monstrous motive."

Two members of the 5-person panel issued a dissenting opinion against the decision. The scandalous ruling sparked a wave of backlash on social media. Lawyer Hüseyin Ersöz also shared his assessment of the decision, stating, "I find it difficult to comprehend from a legal standpoint."

'DESPITE IT BEING CLEARLY STATED...'

Ersöz wrote the following:

"I believe that the Court of Cassation's ruling on the Pınar Gültekin case contains a flawed assessment. Despite the fact that Court of Cassation General Assembly of Criminal Chambers rulings clearly state that 'the act of killing by burning constitutes murder with a monstrous motive' and clearly specify that 'unjust provocation provisions cannot be applied' to this type of crime, I find it difficult to comprehend the reversal decision issued by the 1st Criminal Chamber of the Court of Cassation from a legal standpoint. The conviction was overturned by the votes of 3 members in a chamber consisting of the President and 4 members. The President and 1 member dissented from the reversal decision.
