Imposition of 30-year age limit on student discounts for Istanbulkart taken to court
Murat Türkyılmaz, spokesperson for the AKP Group at the Istanbul Metropolitan Municipality (IMM), announced that they have filed a lawsuit to cancel the IMM Council decision that prevents students who have reached the age of 30 from benefiting from the 'Student Istanbulkart' for transportation.
In a post on his social media account, Türkyılmaz stated, "Our lawsuit has been filed for the cancellation of the IMM practice regarding the inability of students over the age of 30 to benefit from the 'Student Istanbulkart' for transportation."
Stating that he will continue to inform citizens on this matter, Türkyılmaz also included an image of the petition submitted to the court for those who wish to file a lawsuit for the cancellation of the practice.
In the petition submitted by Türkyılmaz to the Istanbul Administrative Court on Duty, it was stated that the decision taken by the IMM Council constitutes a violation of the principle of equality guaranteed by the Constitution.
Referring to Article 10 of the Constitution, titled 'Equality Before the Law,' which states, "Everyone is equal before the law without distinction as to language, race, color, sex, political opinion, philosophical belief, religion, sect, or any such grounds," the application petition noted that the decision in question paves the way for different treatment of people with the same status (students) in society by imposing an age restriction on the definition of a student without showing a reasonable or valid reason.
The petition stated that the administration must observe the principle of equality while exercising its discretionary power, and that it is established by the decisions of the high court that actions contrary to the principle of equality, which is one of the fundamental principles of law, cannot be taken.
The petition included the statement, "Narrowing the scope of users of the 'Student Istanbulkart,' which has been in use for many years in Istanbul public transportation vehicles and from which thousands of students benefit, without reasonable and valid reasons in order to ensure the balance of public income and expenditure, does not justify subjecting the students of the people of Istanbul to different treatment merely by imposing an age restriction," and requested "the cancellation of the municipal council decision numbered 1060 taken by the IMM Council on July 11, 2024, and an urgent stay of execution until the end of the lawsuit, on the grounds that the implementation of the decision will cause irreparable damage."
